Abstract

The surety bond market in Indonesia cannot be denied having promising business potential in Indonesia. However, the enactment of Law No. 1 of 2016 concerning Guarantees still raises legal dualism among the public and general insurance company. The research analysis results shows there are weaknesses in the legal arrangements regarding companies that can market, sell and issue surety bond certificates, where general insurance companies can lose business from surety bond business lines after the enactment of Law No. 1 of 2016. Therefore, to provide legal certainty for general insurance company, a revised step is needed for Article 61 of Law No. 1 of 2016, in order to market, sell and issue surety bond certificates. In addition, the process of legal harmonization can be carried out through horizontal harmonization between Law 40 of 2014, Law No. 1 of 2016, and Law No. 2 of 2017. The point is states that comprehensive and acceptable provisions for amending Article 61 paragraph (1) of Law No. 1 of 2016 Furthermore, the judicial review process to the Constitutional Court can provide legal certainty for general insurance companies to be able to market / sell and issue surety bond products in Indonesia by making changes in the provisions of Article 61 of Law No. 1 of 2016. / Pasar surety bond di Indonesia tidak dapat dipungkiri memiliki potensi bisnis yang menjanjikan di Indonesia. Namun penetapan UU No 1 Tahun 2016 tentang Penjaminan masih menimbulkan dualisme hukum di kalangan masyarakat dan pelaku perusahaan asuransi umum. Analisa hasil penelitian menunjukan terdapat kelemahan pengaturan hukum mengenai perusahaan yang dapat memasarkan, menjual dan menerbitkan sertifikat surety bond, dimana perusahaan asuransi umum dapat kehilangan bisnis dari lini usaha surety bond pasca diundangkan UU No 1 Tahun 2016. Oleh karena itu untuk memberikan kepastian hukum bagi perusahaan asuransi umum, dibutuhkan langkah revisi atas Pasal 61 UU No 1 Tahun 2016, agar dapat memasarkan, menjual dan menerbitkan sertifikat surety bond. Selain itu proses harmonisasi hukum dapat dilakukan melalui harmonisasi horizontal antara UU 40 Tahun 2014, UU No 1 Tahun 2016, serta UU No 2 Tahun 2017. Intinya menyatakan ketentuan yang komprehensif dan dapat diterima untuk mengubah Pasal 61 ayat (1) UU No 1 Tahun 2016, selanjutnya, proses judicial review ke Mahkamah Konstitusi dapat memberikan kepastian hukum bagi perusahaan asuransi umum untuk dapat memasarkan/ menjual dan menerbitkan produk surety bond di Indonesia dengan melakukan perubahan dalam ketentuan Pasal 61 UU No 1 Tahun 2016.
