Abstract
Ukuran kesejahteraan masyarakat Indonesia salah satunya bergantung pada
kualitas makanan dan pasokan makanan bagi masyarakat. Hal ini secara tidak
langsung terkati dengan hak-hak yang konsumen miliki. Hak-hak konsumen yang
diakui oleh produsen akan membuat produsen untuk lebih hati-hati memproduksi
barang dan atau jasa mereka. Akan tetapi faktanya tidak semua konsumen
memahami hak-hak mereka. Oleh karena itu produsen cenderung memanfaatkan
situasi ini sebagai lahan untuk mendapatkan keuntungan lebih. Ketika konsumen
mendapat kerugian atas barang dan atau jasa yang diproduksi oleh produsen,
konsumen secara tidak langsung dipaksa untuk menerima kerugian yang dibuat
oleh produsen. Atas dasar tersebut maka penelitian ini menjabarkan
pertanggungjawaban produsen terhadap konsumen yang dirugikan.
Penelitian ini memfokuskan pada tanggung jawab produsen makanan
terhadap bahan makanan hasil produksinya, apabila barang dan atau jasa yang
diproduksi merugikan konsumen. Oleh karena itu, tidak lepas kaitannya mengenai
produk pangan terhadap standar mutu dan kualitas pangan. Penelitian ini
menggunakan tipe yuridis normatif, dimana pengolahan bahan hukum dilakukan
secara studi pustaka.
Hasil yang didapat dari penelitian ini adalah bahwa produsen otak-otak di
sukabumi yaitu Rika, terbukti memproduksi otak-otaknya dengan bahan
berbahaya, setelah polisi menemukan bahan dasar ikan busuk, tambahan pangan
berbahaya yaitu boraks, serta adonan jadi yang siap dipasarkan ke pasar sekitar.
Penggunaan bahan ini adalah tidak sesuai dengan ketentuan perundang-undangan. / One of the welfare measurements In Indonesia relies on fulfillment of food
supply to citizen and food quality standard. This is indirectly related to the rights
of consumer. Consumer rights that acclaimed by producer will make producer
more careful to the goods or services they are going to make. However, not all
consumers know about his or her rights. Therefore, producers tend to use this
situation as a land to get more benefits. When consumer got loss at the goods and
services producer made, consumer indirectly forced to accept the loss. Because of
this issue, this research defines producer liabilities to consumer who had loss after
using producer’s product.
This research focused on food producer liabilities to the harmed ingredients
in food. The Ingredients itself, were connected on the food product against quality
standards and food quality. This research used a normative type, where the legal
materials processing performed by literature.
The result that has successfully collected through this research is producer of
otak-otak in Sukabumi, named Rika, proved to produce otak-otak with harmed
ingredients. After police found basic ingredients, which are rotten fishes,
dangerous ingredients adding, like borax and formalin. Also otak-otak that were
ready to sell in markets around Sukabumi. The uses of this dangerous ingredients,
was conclude as an action, which disobey the rules.
