Harta bersama dalam perkawinan pada prinsipnya dimiliki secara bersama, sehingga pengurusannya harus dengan persetujuan pasangannya. Namun, ketika berbicara mengenai harta berupa saham, maka umumnya masyarakat akan tunduk pada aturan dalam UU PT yang hanya mengatur peralihan dilakukan dengan akta pemindahan hak. Tujuan penelitian ini adalah untuk menganalisis pengaturan peralihan hak atas saham yang diperoleh selama perkawinan berlangsung berdasarkan UU PT dan UUP serta akibat hukum terhadap perjanjian peralihan yang dilakukan tanpa persetujuan istri. Penelitian ini menggunakan penelitian normatif empiris, yakni dengan mengkaji implementasi ketentuan hukum tertulis terhadap peristiwa yang terjadi di masyarakat, kemudian didukung dengan wawancara. Hasil penelitian menunjukan bahwa adanya kekosongan hukum dalam UU PT dimana tidak mengatur peralihan hak atas saham ketika diperoleh selama perkawinan berlansgung, sedangkan UUP mengatur peralihan hak atas saham harus dengan persetujuan pasangan ketika termasuk dalam harta bersama. Akibat hukum terhadap perjanjian peralihan hak atas saham tanpa persetujuan istri adalah dapat dibatalkan karena melanggar syarat sah perjanjian, yakni syarat subjektif. Tindakan tersebut juga merupakan Perbuatan Melawan Hukum. / Joint property in marriage is fundamentally co-owned, necessitating management with spousal consent. However, when talking about property in the form of shares, the public typically adheres to Company Law, governing transfers through deeds of transfer. This study aims to analyze the regulatory framework for the transfer of share rights acquired during marriage, based on Company Law and Marriage Law, and the legal repercussions of transfer agreements without the wife's consent. This research uses empirical normative research, namely by examining the implementation of written legal provisions against events that occur in society, then supported by interviews. The results show that there is a legal vacuum in the Company Law which does not regulate the transfer of rights to shares when acquired during marriage, while the Marriage Law regulates the transfer of rights to shares must be with the consent of the spouse when included in joint property. The legal effect of the agreement on the transfer of rights to shares without the consent of the wife is that it can be canceled because it violates the validity of the agreement, namely the subjective requirement. This action is also classified as a Wrongful Act.
