Abstract

Untuk mengesahkan jual-beli tanah antara penjual-pembeli maka sudah wajib untuk melibatkan Notaris dan juga Pejabat Pembuat Akta Tanah agar dapat membuat akta otentik. Namun ada peraturan baru mengenai tanah Lahan Sawah Dilindungi (LSD) yang menetapkannya kepada sejumlah tanah di 8 provinsi Indonesia dan memberi berbagai banyak larangan untuk tanah tersebut. Salah satu dari 8 provinsi tersebut merupakan provinsi Bali dimana penulis melakukan kegiatan magang yang menjadi dasar utama penulisan laporan magang ini. Berdasarkan hal-hal tersebut, ada tanggung jawab Notaris untuk membantu dan memainkan peran yang penting dalam proses jual-beli tanah yang sedang dalam status LSD. Dalam kegiatan magang ini, penulis fokus mempelajari larangan yang berlaku untuk tanah LSD serta perbedaan proses jual-beli nya dibanding dengan tanah secara umum. Bukan hanya itu tetapi penulis juga melakukan observasi akan tanggung jawab Notaris dalam membantu melancarkan proses tersebut. Hasil laporan magang ini menunjukkan bahwa pada tahap akhir dari jual-beli, tanah tidak dapat dilakukan balik nama sertifikat sehingga hanya dapat dilakukan akta perjanjian dan kuasa menjual di depan Notaris sebagai bukti sah transaksi. / To legalize the sale and purchase of land between a seller and a buyer, it is mandatory to involve a Notary and also a Land Deed Official or PPAT in order to make an authentic deed. However, there is a new regulation on Protected Rice Field (LSD) land that applies to a significant portion of land in 8 provinces in Indonesia and enforces many restrictions on such land. One of the 8 provinces is the province of Bali where the author conducted his internship which is used as the main basis for writing this internship report. Based on this, it is the responsibility of the Notary to assist and play an important role in the process of buying and selling land that is under LSD status. In this internship, the author focused on studying the restrictions that apply to LSD land and the differences in the process of buying and selling compared to land in general. Not only that, but the author also observed the responsibilities of the Notary within such a process. The results of this internship report show that in the final process of the sale-purchase of land, the LSD land title cannot be transferred due to restrictions which means that the final legal proof of the purchase of land would be within the authentic deed of agreement and power of attorney to sell (Kuasa Menjual) that is made in front of a Notary.
