Abstract

Pejabat Pembuat Akta Tanah (PPAT) berwenang untuk membuat akta-akta yang sebagaimana diatur di dalam Peraturan Kepala Badan Pertanahan Nasional Nomor 8 Tahun 2012, tetapi sebelum dibuatkannya akta-akta tersebut PPAT wajib melakukan pengecekan sertipikat berdasarkan Pasal 97 ayat (1) Peratururan Menteri Agraria dan Tata Ruang/Kepala Badan Pertanahan Nasional Nomor 16 Tahun 2021, sehingga permasalahan penelitian yang diangkat adalah pelaksanaan proses pengecekan data fisik dan data yuridis atas tanah dalam sertipikat oleh Pejabat Pembuat Akta Tanah (PPAT), serta kepastian hukum pengecekan data fisik dan data yuridis oleh Pejabat Pembuat Akta Tanah (PPAT) atas sertipikat sebelum dilakukannya suatu perbuatan hukum hak atas tanah. Penelitian ini menggunakan metode penelitian yuridis normatif dan analisis kualitatif, menggunaka data sekunder, serta menggunakan pendekatan perundangn-undangan, konseptual, analisis hukum dan kasus. Dari hasil penetilan bahwa pengecekan sertipikat oleh Pejabat Pembuat Akta Tanah (PPAT) sebelum dilakukannya pembuatan akta mengenai suatu perbuatan hukum merupakan kewajiban sesuai dengan Pasal 97 ayat (1) Peraturan Menteri Agraria dan Tata Ruang/Kepala Badan Pertanahan Nasional Nomor 16 Tahun 202, hal ini bertujuan untuk mengindari adanya permasalahan seperti gugatan, sengketa, blokir, sita jaminan dan tumpang tindih (overlapping), dengan memperhatikan memperhatikan Permen ATR No 19 Tahun 2020, Petunjuk Teknis Nomor 5/Juknis-100.HK.02/VIII/2021 dan Petunjuk Teknis Nomor 3/Juknis-HK.02/IV/2022. Hasil dari pengecekan tersebut PPAT serta para pihak diberikan litimasi kepastian hukum selama 7 (tujuh) hari kalender sebagaimana diatur dalam Pasal 39 PP 24 Tahun 1997. Litimasi tersebut berartikan bahwa PPAT ini hanya diberikan kepastian hukum oleh negara terhadap obyek tanahnya selama 7 (tujuh) hari, dalam waktu tersebut PPAT dapat membuat akta yang diinginkan oleh pihak yang berkepentingan, jika pembuatan akta melebihin waktu tersebut, PPAT wajib melakukan pengecekan sertipikat kembali, kerena setelah lewat dari litimasi tersebut di mungkinkan terjadi suatu permasalahan. / The Land Deed Making Official (PPAT) has the authority to make deeds as regulated in the Regulation of the Head of the National Land Agency Number 8 of 2012, but before making the deeds the PPAT is obliged to check the certificate based on Article 97 paragraph (1) of the Regulation of the Minister of Agrarian Affairs. and Spatial Planning/Head of the National Land Agency Number 16 of 2021, so that the research problem raised is the implementation of the process of checking physical data and juridical data on land in certificates by the Land Deed Making Official (PPAT), as well as legal certainty of checking physical data and juridical data by Land Deed Making Official (PPAT) on the certificate before carrying out a legal act on land rights. This research uses normative juridical research methods and qualitative analysis, uses secondary data, and uses legislative, conceptual, legal and case analysis approaches. From the results of the investigation, checking the certificate by the Land Deed Making Officer (PPAT) before making a deed regarding a legal act is an obligation in accordance with Article 97 paragraph (1) of the Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency Number 16 of 202, this is aims to avoid problems such as lawsuits, disputes, blocking, collateral confiscation and overlapping(overlapping), taking into account ATR Ministerial Regulation No. 19 of 2020, Technical Instructions Number 5/Juknis-100.HK.02/VIII/2021 and Technical Instructions Number 3/Juknis HK.02/IV/2022. As a result of these checks, PPAT and the parties were given legal certainty for 7 (seven) calendar days as regulated in Article 39 of PP 24 of 1997. This litigation means that PPAT is only given legal certainty by the state regarding its land objects for 7 (seven) days. , within that time PPAT can make the deed desired by the interested party, if the making of the deed exceeds that time, PPAT is obliged to check the certificate again, because after the litigation, it is possible that a problem will occur.
