Abstract

Perkembangan teknologi dalam sektor finansial telah menciptakan mata uang kripto yang sekarang populer di antara masyarakat global. Keberadaan tipe mata uang baru ini, tidak bisa dipungkiri, mempermudah transaksi ekonomi yang setiap harinya terjadi. Sayangnya, fenomena globalisasi digital ini berujung pada tantangan keamanan dan hukum. Legalitas daripada penggunaan mata uang kripto pun dipertanyakan atas ketiadaan struktur hukum yang mampu mengaturnya. Dalam kasus Uni Eropa, penerapan regulasi mata uang kripto menjadi suatu dilema yang kompleks, yang penuh dengan gejolak politik internasional. Upaya mereka terlihat dalam penetapan beberapa kebijakan hukum seperti Anti-Money Laundering (AML) dan Countering Financing of Terrorism (CFT). Namun, kedua regulasi tersebut kurang efektif untuk mengikuti perkembangan kripto yang begitu pesat. Kegagalan AML dan CFT mendorong Uni Eropa kepada satu tujuan bersama yakni mewujudkan rezim internasional yang dapat meregulasi dan mengawasi setiap transaksi kripto. Penelitian ini bersifat kualitatif dan akan dianalisis melalui pandangan neoliberalisme serta konsep game theory untuk menyoroti terbentuknya kerja sama antarnegara anggota Uni Eropa dalam meregulasi mata uang kripto. Menggunakan data sekunder yang terkumpul dari berbagai sumber daring serta artikel jurnal yang dipublikasikan oleh Uni Eropa. Dari hasil penelitian ini, ditemukan bahwa meskipun negara-negara bertindak sesuai dengan kepentingan nasionalnya, mereka mempunyai pandangan optimistik mengenai kemungkinan kerja sama. Hal ini mendorong berdirinya MiCA atau Markets in Crypto Assets, menjadikannya yurisdiksi terbesar pertama di dunia yang memperkenalkan peraturan komprehensif terkait mata uang kripto./The development of technology in the financial sector has given rise to cryptocurrencies, which are now popular among the global community. The existence of these new types of currencies undeniably facilitates daily economic transactions. Unfortunately, this phenomenon of digital globalization has led to security and legal challenges. The legality of using cryptocurrencies is questioned due to the absence of a legal framework capable of regulating them. In the case of the European Union, the implementation of cryptocurrency regulations becomes a complex dilemma, fraught with international political turmoil. Their efforts are evident in the establishment of legal policies such as Anti-Money Laundering (AML) and Countering Financing of Terrorism (CFT). However, both regulations are less effective in keeping pace with the rapid development of cryptocurrencies. The failure of AML and CFT propels the European Union toward a common goal of realizing an international regime capable of regulating and overseeing every crypto transaction. This qualitative research will be analyzed through the lenses of neoliberalism and the concept of game theory to highlight the formation of cooperation among member states. By using secondary data findings along with published journals and articles by the European Union. The findings of this research reveal that, despite countries acting in accordance with their national interests, they hold optimistic views regarding the possibility of cooperation. This has led to the establishment of MiCA or Markets in Crypto Assets, making it the world's first and largest jurisdiction to introduce comprehensive regulations related to cryptocurrencies.
