Abstract
Dilatarbelakangi oleh adanya praktik jual beli dengan objek hak atas tanah yang didahului dengan suatu perjanjian yang disebut dengan Perjanjian Pengikatan Jual Beli Hak atas tanah (PPJB). PPJB merupakan suatu bentuk perjanjian sebelum
dilaksanakannya jual beli hak atas tanah. Isu yang mengemuka kemudian, apakah penggunaan PPJB tersebut dapat diterima dan dijadikan dasar pengalihan hak atas tanah kepada pihak lain sehingga dapat memberikan suatu kepastian hukum. Tulisan ini dimaksudkan untuk memperoleh jawaban terhadap permasalahan tersebut dan selanjutnya dapat dipergunakan untuk membentuk norma hukum yang lebih eksplisit mengenai PPJB. Dengan metode hukum normatif dan menggunakan dua pendekatan, yaitu pendekatan konseputual dan pendekatan perundang-undangan, diperoleh jawaban, bahwa: Pertama, kedudukan hukum PPJB dapat diterima sebagai hukum yang hidup dalam praktik masyarakat Indonesia, serta untuk mengisi kekosongan norma hukum dalam hal perbuatan hukum jual beli dengan objek tanah. Kedua, pembayaran lunas terhadap harga dalam PPJB tidak serta merta sertifikat atas peralihannya tersebut dapat didaftarkan hakNya ke Kantor Pertanahan setempat. / The background is the practice of buying and selling with the object of land rights which is preceded by an agreement called the Land Rights Binding Sale and Purchase Agreement (PPJB). PPJB is a form of agreement before the sale and purchase of land rights is carried out. The issue that emerged then was whether the use of the PPJB could be accepted and used as a basis for transferring land rights to other parties so that it could provide legal certainty. This article is intended to obtain answers to these problems and can then be used to form more explicit legal norms regarding PPJB. Using the normative legal method and using two approaches, namely the conceptual approach and the statutory approach, the answer obtained is that: First, the legal standing of PPJB can be accepted as a living law in the practice of Indonesian society, as well as to fill the gap in legal norms in terms of legal acts of buying and selling land objects. Second, full payment of the price in the PPJB does not necessarily mean that the transfer certificate can be registered with the local Land Office.
