Salah satu komponen dalam memperoleh pendapatan, harga tiket pesawat terbang didasarkan pada penetapan tarif batas atas sebagaimana diamanatkan pada Pasal 130 Undang-Undang Nomor 1 Tahun 2009 tentang Penerbangan, dan diatur lebih lanjut pada Peraturan Menteri Perhubungan Nomor 20 Tahun 2019. Rumusan masalah dalam penelitian ini adalah bagaimana sikap pelaku usaha terhadap penetapan harga tiket pesawat terbang ditinjau dari PM 20 Tahun 2019 dan bagaimana penetapan tarif batas atas ditinjau dari hukum persaingan usaha. Penelitian ini menggunakan metode yuridis normatif yang didukung oleh empiris. Kesimpulan dari penelitian ini adalah pertama, para maskapai selaku pelaku usaha maupun asosiasi maskapai/Indonesia National Air Carriers Association (INACA) tidak setuju dengan penetapan tarif batas atas sebagaimana yang tertuang pada PM 20 Tahun 2019 dan mengajukan kepada pemerintah untuk menghapuskan penetapan tarif batas atas tersebut dengan mempertimbangkan kelangsungan usaha secara berkelanjutan yang berprinsip pada keadilan. Kedua, mengacu pada hukum persaingan usaha, penetapan tarif batas atas merupakan bentuk peniadaan persaingan, sehingga harga tiket pesawat perlu didasarkan pada mekanisme pasar. Mekanisme pasar akan membentuk harga berdasarkan penawaran dan penerimaan yang dicapai berdasarkan kehendak yang diharapkan oleh para pihak. Mekanisme pasar akan mendorong persaingan yang sehat yang akan memberikan dampak keadilan bagi para pihak, baik bagi pelaku usaha maupun penumpang. / One of the components in generating revenue, the price of airplane tickets is subject to the establishment of an upper limit tariff as mandated in Article 130 of Law Number 1 of 2009 on Aviation, where the provisions regarding the establishment of air transport tariffs are further regulated under Minister of Transportation Regulation Number 20 of 2019. The formulation of the problem in this study is how the behavior of business operators towards the establishment of airplane ticket prices reviewed from the Minister of Transportation Regulation Number PM 20 of 2019 and how the establishment of upper limit tariffs is viewed from the business competition law. This research applied normative juridical method supported by empirical data. This study concludes that, first, the airlines as business operators, as well as airline associations/Indonesia National Air Carriers Association (INACA), disagree with the establishment of the upper tariff limit on airplane ticket prices as stated in Ministerial Regulation Number 20 of 2019 and propose to the government to eliminate the provisions of the upper tariff limit on airplane ticket prices due to the sustainability of the business based on the principles of justice. Second, in accordance with the legal aspects of business competition, the establishment of an upper tariff limit on airplane ticket prices is a form of absence of competition, therefore airplane ticket prices must be based on market mechanisms. The market mechanism will form a price based on an offer and acceptance. The market mechanism will encourage fair competition, thereby providing justice for all parties, with each party receiving reasonable rights, both by business operators and passengers
