Abstract

Technological advancement have exceeded the expectations of what people in the past could have imagined. Technologies such as Mobile Phones, Tablet, Computer, etc. It already feels like ordinary technology or an everyday item that are indispensable. Nowadays, a new form of technology has emerged which has extraordinary capabilities, namely that this technology can learn on its own and carry out work that only could have been done by humans. This technology is called Artificial Intelligence. This research will answer two problems, first is how the regulation of trade secrets in Indonesia regulates the protection of trade secrets and second are the legal liability of Artificial Intelligence service providers for leaks of confidential company data protected under Indonesia trade secrets law. This research aims to first solve legal problems arising from the liability of Artificial Intelligence service providers for leaks of confidential company data, second is to develop legal discovery in the future from the results of this research. The research also uses two law theories which are legal protection theory and legal responsibility theory in the form of normative research. The result of the research is that Indonesia regulation regarding trade secrets law protects the interests of company confidential data that is leaked by service providers that are hired by the E-Commerce company. The result of the leak would be breach of contract and legal sanctions in the form of civil and penal based on the lawsuit that is proposed to the court by the E-Commerce company. The sanctions would lead to compensation for the leak of confidential company data or criminal charges.
