Abstract

"Negara memiliki kewajiban untuk menciptakan dan meningkatkan kesehatan yang menjamin masyarakatnya mendapatkan kesehatan yang layak. Lembaga pemerintah Badan Pengawas Obat dan Makanan (BPOM) memiliki tugas dan wewenang dalam pengawasan dan peredaran obat di Indonesia sebagaimana diatur dalam Peraturan Presiden Nomor 80 Tahun 2017 Tentang Badan Pengawas Obat dan Makanan. Pengawasan yang dilakukan pemerintah terhadap peredaran obat saat ini belum mencakup keseluruhan permasalahan, terbukti dari kasus yang viral di masyarakat yaitu obat sirup anak mengandung zat berbahaya Etilen Glikol (EG) dan Dietilen Glikol (DEG) yang menyebabkan kematian atau yang kita kenal dengan kasus Gagal Ginjal Akut Pada Anak (GGAPA). Penelitian tesis ini merumuskan dua permasalahan yaitu bagaimana pengaturan terhadap pengawasan dan peredaran obat sesuai dengan peraturan perundang-undangan di Indonesia dan bagaimana peran negara dalam melakukan pengawasan terhadap peredaran obat yang dikonsumsi oleh anak agar dapat terjamin kualitas dan keamanannya. Penelitian ini menggunakan metode normatif-empiris dengan pendekatan studi kasus hukum yang didukung dengan wawancara. Kesimpulan dari penelitian ini secara normatif: pertama, pengaturan BPOM dalam Peraturan Presiden Nomor 8 Tahun 2017 Tentang Badan Pengawas Obat dan Makanan belum sepenuhnya mengatur dan mencakup keterbukaan terkait uji klinis obat agar terjamin kualitas dan keamanan obat dari kandungan berbahaya dan pengaturan saat ini hanya mencakup pre-market dan post-market. Kedua, secara kelembagaan, BPOM saat ini belum memiliki kewenangan yang kuat untuk mengawasi peredaran obat di Indonesia, saat ini kewenangan untuk mengawasi peredaran obat masih tumpang tindih antara BPOM dengan Kementerian Kesehatan dan Kementerian Perdagangan. Ketiga, pengaturan pemberian sanksi apabila terjadi permasalahan hukum belum memberikan efek jera bagi pelaku. Secara empiris: pertama, peran negara dalam pencegahan terkait pengawasan dan peredaran obat di Indonesia belum optimal, fungsi dan peran negara dalam menjamin kepastian hukum bagi warga negara nya dalam jaminan keamanan terhadap kandungan obat yang dikonsumsi belum terwujud. Kedua, Penanganan kasus GGAPA yang terjadi menunjukkan penanganan yang masih belum tuntas, pemberian hak korban sampai pulih kembali belum terlaksana bahkan keluarga korban harus membeli sendiri alat untuk bantu pernapasan. / The state has an obligation to create and improve health that guarantees its people get proper health. The government agency Badan Pengawas Obat dan Makanan (BPOM) has the duty and authority to supervise and distribute drugs in Indonesia as stipulated in Presidential Regulation No. 80/2017 on the Food and Drug Supervisory Agency. The supervision carried out by the government on the circulation of drugs currently does not cover all problems, as evidenced by the viral case in the community, namely children's syrup containing hazardous substances Ethylene Glycol (EG) and Diethylene Glycol (DEG) which caused death or what we know as the case of Acute Kidney Failure in Children (GGAPA). This thesis research formulates two problems, namely how the regulation of the supervision and circulation of drugs in accordance with the laws and regulations in Indonesia and how the role of the state in supervising the circulation of drugs consumed by children so that their quality and safety can be guaranteed. This research uses a normative-empirical method with a legal case study approach supported by interviews. The conclusions of this research are normative: first, the regulation of BPOM in Presidential Regulation Number 8 of 2017 concerning the Food and Drug Supervisory Agency has not fully regulated and covered disclosure related to drug clinical trials to ensure the quality and safety of drugs from harmful content and the current regulation only covers pre-market and post-market. Secondly, institutionally, BPOM currently does not have a strong authority to oversee drug distribution in Indonesia, currently the authority to oversee drug distribution still overlaps between BPOM and the Ministry of Health and the Ministry of Trade. Third, the regulation of sanctions in the event of legal problems has not yet provided a deterrent effect for the perpetrators. Empirically: first, the role of the state in prevention related to the supervision and circulation of drugs in Indonesia is not optimal, the function and role of the state in ensuring legal certainty for its citizens in guaranteeing the safety of the content of drugs consumed has not been realized. Secondly, the handling of GGAPA cases that have occurred shows that the handling is still incomplete, giving victims the right to recover has not been implemented and even the families of victims have to buy their own breathing apparatus".
