Abstract

Pelaksanaan pemberian kredit oleh Bank diawali dengan adanya perjanjian kredit antara kreditor dengan debitor. Diperlukan jaminan atau agunan sebagai syarat kesanggupan debitor untuk melunasi kredit sesuai dengan apa yang telah diperjanjikan. Jaminan yang diberikan kepada Bank berupa tanah dan bangunan yang mana perlu dipasangkan Hak Tanggungan (HT) dengan tujuan memudahkan proses eksekusi jika debitor mengalami wanprestasi. Penelitian ini menggunakan jenis penelitian normatif empiris dengan menggunakan jenis pendekatan terhadap case study yaitu Putusan Nomor:28/Pdt.G/2017/PN PRP. Dalam penelitian ini penulis akan meneliti fakta hukum, konstruksi hukum, pelaksanaan peraturan perundang-undangan terkait penandatanganan Surat Kuasa Membebankan Hak Tanggungan (SKMHT) yang dibuat secara notariil untuk proses pemasangan Hak Tanggungan dalam pengikatan jaminan kredit Bank. SKMHT yang dibuat tanpa akta notariil dan terdegradasi menjadi akta dibawah tangan adalah berpotensi dapat dibatalkan karena melanggar ketentuan 1 dan 2 dalam Pasal 1320 KUH Perdata yaitu unsur sepakat dan melanggar Pasal 15 ayat (1) UU HT yang mengatakan SKMHT wajib dibuat dalam bentuk akta autentik. Akibat dari kreditor dan debitor yang membuat perjanjian Hak Tanggungan tanpa akta notaril adalah Hak Tanggungan tersebut tidak dapat didaftarkan di Kantor Pertanahan dan berhubungan dengan eksekusi jaminan jika terdapat wanprestasi. / The implementation of credit provision by the Bank begins with the existence of a credit agreement between the creditor and the debtor. Guarantee or collateral is required as a condition of the debtor’s ability to repay the credit in accordance with that has been agreed. The collateral given to the Bank is in the form of land and buildings which need to be attached with Mortgage Rights with the aim of facilitating the execution process if the debtor experiences default. This research uses a type of empirical normative research using a case study type of approach, namely Decision Number: 28/Pdt.G/2017/PN PRP. In this research, the author will examine legal facts, legal construction, implementation of laws and regulations related to the signing of SKMHT which is made notarially for the process of encumbrance of mortgage in binding Bank credit guarantees. SKMHT which is made without a notarial deed and it will be degraded to a private deed and has the potential to be canceled because it violates provisions 1 and 2 in Article 1320 of the Civil Code, namely the element of agreement and violates Article 15 paragraph(1) of the HT Law which states that SKMHT must be made in form of an authentic deed. The consequence of creditors and debtors making a Mortgage Agreement without a notarial deed is that the Mortgage Rights can not be registered at the Land Office and are related to the execution of collateral if there is a default
