Abstract

Perkembangan teknologi di dunia yang berjalan begitu pesat saat ini memiliki dampak secara luas terhadap kebiasaan hidup manusia. Salah satunya mengenai penataan administrasi Negara terkait penyelenggaraan pelayanan perizinan sistem online single submission terhadap kegiatan usaha yang dilakukan oleh pelaku usaha. Selanjutnya dalam perjalanan penyelenggaraan pelayanan perizinan berbasis online, melalui Undang-Undang No. 11 Tahun 2020 tentang Cipta Kerja, mengubah paradigma perizinan dari berbasis izin (Licensing-Based Approach) yakni Online Single Submission Versi 1.1 menjadi pendekatan berbasis risiko (Risk-Based Approach/RBA) yakni Online Single Submission Risk Based Approach (OSS-RBA). Meskipun penerapannya masih belum sempurna karena berbagai masalah ditemukan dari mulai peraturan yang dibuat antara Pemerintah Pusat dengan Pemerintah Daerah belum sinkron penerapannya, Kurangnya pemahaman masyarakat khususnya pelaku usaha dalam sektor pertanian terkait izin usaha berbasis online, jaringan internet yang belum secara menyeluruh dijangkau di tiap daerah di Indonesia, dan masalah lainnya yang secara tidak langsung menjadi hambatan keberhasilan penyelenggaraan pelayanan perizinan online single submission. Sektor pertanian bergantung pada jumlah sumber daya alam yang terkandung di wilayah Indonesia dan sumber daya manusia yang berkualitas, pengembangan kegiatan usaha juga dapat bergantung pada kepercayaan investor atau penanam modal dalam negeri ataupun luar negeri untuk menanamkan modalnya dalam sektor pertanian. / The rapid development of technology in the world today has a broad impact on human living habits. One of them concerns the structuring of State administration related to the implementation of online single submission system licensing services for business activities carried out by business actors. Furthermore, in the course of implementing online-based licensing services, through Law no. 11 of 2020 concerning Job Creation, changes the licensing paradigm from a permit-based approach (Licensing-Based Approach), namely Online Single Submission Version 1.1, to a risk-based approach (RBA), namely Online Single Submission Risk Based Approach (OSS-RBA). Even though its implementation is still not perfect because various problems have been found, starting from regulations made between the Central Government and Regional Governments that have not yet been implemented in sync, there is a lack of public understanding, especially business actors in the agricultural sector, regarding online-based business permits, internet networks that have not been fully reached in every region in Indonesia, and other problems which indirectly become obstacles to the success of implementing online single submission licensing services. The indirect impact is on the development of the country. This is because the agricultural sector apart from depending on the amount of natural resources contained in Indonesia and quality human resources, the development of business activities can also depend on the confidence of domestic or foreign investors or investors to invest their capital in the agricultural sector.
