Abstract

This research aims to solve the problem regarding the form of legal certainty regarding the minimum copyright royalty rates for songs and/or music in music streaming applications such as Spotify based on Government Regulation Number 56 of 2021 concerning the Management of Song and/or Music Copyright Royalties and other related regulations. This research was conducted using a combined research method between a normative legal approach and an empirical approach referred to as normative- empirical legal research. The legal materials in this research used primary legal materials and secondary legal materials, and the data collection method used literature studies and interviews. Rapid developments in the fields of technology and information have also changed the way people enjoy music. Spotify as one of the largest music streaming platforms does not fail to play a role in supporting the provision of services to enjoy music exclusively on each user's device. This situation will be a loss for creators and copyright holders of songs and/or music if there is no legal umbrella that provides legal certainty regarding the provisions on copyright royalty rates for songs and/or music. Through Government Regulation Number 56 of 2021 concerning Management of Song Copyright Royalties, the minimum royalty rate for commercial activities has been regulated, however, the type of commercial activity in the form of music streaming applications has not been regulated in this regulation. The government through the State Collective Management Institute (LMKN) plays an important role in managing royalties based on issued licenses. It is hoped that the existence of LMKN can ensure more targeted and fair royalty payments by continuing to carry out outreach efforts, strict law enforcement, and improving the community's legal culture.
