The study aims to determine the law on the protection of to the protection of freedom of speech through the internet which is set the Act. 11 Year 2008 on Information and Transactions Electronic viewed from the perspective of human rights. This research is a normative legal prescriptive. The method used in this research is a method normative. Data obtained and analyzed by grammatical interpretation and interpretation systematic examination of the provisions contained in the Act ITE. The results showed that the law No. 11 Years 2008 on Information and Electronic Transactions cannot be said to have protect the freedom of expression of a person as personal right to communicate via the Internet. As has been explained that the provisions of the Act relating to the ITE freedom of speech is only regulated in one article and there are only a prohibition without rights. Based on that, then that provision it is still obscurity. So requires setting Further the Act ITE. As human rights are also included within the political right individual and personal rights, freedom of expression must be absolute protected and cannot be reduced. But considering that the right is also raise an obligation to honor and respect the rights of others, the implementation of these rights may be restricted by law.
