Abstract

COD merupakan sistem pembayaran yang dilakukan secara langsung di tempat, Metode pembayaran dalam COD ini yaitu setelah pesanan dari kurir diterima oleh Pembeli. Cara kerja COD adalah pembeli membayar pesanan secara tunai ke kurir sebelum paket dibuka. Penelitian ini membahas tentang keberlakuan system Cash On Delivery pada marketplace TikTok Shop dan Perlindungan hukum terhadap pelaku usaha yang menggunakannya. Tujuan penelitian ingin dicapai adalah untuk mengkaji dan menganalisis implementasi peraturan Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen dan Kitab Undang-Undang Hukum Perdata Berkaitan Dengan Perlindungan Hukum Dalam Melakukan Transaksi Jual Beli Melalui Sistem COD Pada Marketplace Tiktok Shop.Dengan jenis penelitian yuridis normatif yaitu penelitian hukum kepustakaan dengan sumber bahan-bahan hukum primer, sekunder dan tersier. Sebagaimana yang telah ditekankan di dalam Undang-Undang Nomor 8 Tahun 1999 Tentang Perlindungan Konsumen, menekankan bahwa kedudukan yang sama dan berkewajiban untuk melaksanakan hak-hak pelaku usaha sebagaimana yang disebutkan dalam Pasal 6 Undang Undang Perlindungan Konsumen Nomor 8 Tahun 1999. / This study explores the validity of the Cash On Delivery (COD) system on the TikTok Shop marketplace and legal protection for businesses utilizing COD. COD is a payment method where buyers pay in cash directly to the courier upon receiving the order. If the order is unsatisfactory, damaged, or defective, buyers can request a refund or return through the TikTok Shop application. The research aims to analyze the implementation of consumer protection laws and the Civil Code, specifically Law Number 8 of 1999, concerning businesses using the COD system on the TikTok Shop platform. This study utilizes normative legal research, specifically library research or secondary data with primary, secondary, and tertiary legal sources. Legal protection, outlined in Law Number 8 of 1999 on Consumer Protection, is the state's effort to safeguard citizens' rights and obligations, aiming to protect against harmful actions and fulfill the law's protective function. The law emphasizes the equal position of businesses and consumers, obligating them to uphold business rights, particularly Article 6 of Law Number 8 of 1999 on Consumer Protection. This includes consumers meeting payment obligations after reaching a consensus in the online purchase agreement via the TikTok Shop application.
