Abstract
The implementation of Telemedicine and traditional healthcare services involves adherence to medical standards and ethics. Despite efforts to uphold these, errors or malpractice may occur, leading to patient harm. This study explores legal accountability in Telemedicine, addressing two questions: 1) How is doctors' legal responsibility determined in Telemedicine practice? 2) What legal protections exist for patients? Employing a normative-empirical research method, the study considers various relationships between doctors and hospitals. There are several patterns in the relationship between doctors and hospitals, namely: 1) doctors as employees; 2) doctors as partners; and 3) doctors as independent contractors. The
responsibility of the parties in the event of a diagnostic error in Telemedicine practice organized by the hospital depends on the legal relationship established between them. Patients affected by Telemedicine-related losses can seek
compensation under Consumer Protection Law. Healthcare professionals, medical personnel, hospitals, and platforms are obligated to maintain the confidentiality of data and information in Telemedicine. Access to patient data requires prior consent, as per Ministry of Health regulations. Overall, the research aims to outline doctor accountability and legal protections in Telemedicine practice.
