This research examines the legal certainty comparison between auction deed and sale and purchase agreement in the process of transferring rights to land and buildings. The primary focus of the study is to understand the significant differences between these two legal instruments and their implications for legal certainty in land and building transactions. Auction minutes are found to emphasize the strength o evidence involving three dimensions, making it a comprehensive proof instrument. Indepth analysis of auction minutes reveals its crucial role in providing clarity regarding the transaction process, rights, and obligations of the parties involved. Meanwhile, the deed of sale exhibits a dual function as a concrete evidence tool and the basis for changes in land registration data. In this context, the research employs a normative analysis method to investigate the strengths and weaknesses of each legal instrument. The main objective is to provide a better understanding of the contributions and positive or negative impacts of using auction minutes and deeds of sale on legal certainty in the transfer of rights to land and buildings. The results of this research illustrate that these differences create complex dynamics in the property rights transfer process. Conclusions are drawn based on a thorough analysis of the research findings, offering a holistic view of the challenges and opportunities that arise. This study is expected to contribute to a better understanding of auction deeds and sale and purchase agreement in the process of transferring rights to land and buildings.
