Abstract
Business competition in globalization is tight, making companies efficient in terms of operations and selection of human resources, so recruiting workers through an outsourcing system will be a strategic choice for business actors, because it is fast and cost efficient. However, after the Job Creation Law was passed, there were
problems related to the protection of outsourcing workers. The research method used is empirical normative, namely research that examines in the form of laws and regulations, legal principles and principles, legal theory and examines
literature materials and interviews with related parties. The types of data used are primary data and secondary data with the types of statutory approaches, case approaches, and conceptual approaches. Then, the findings will be analyzed by qualitative methods. The results show that guarantees of fair rights and protections for outsourcing workers are essential to ensure fairness in their work. Although the Job Creation Law regulates responsibilities related to wages and
rights, there are still issues with wages that are not comparable to the entrance fees and the use of outsourcing workers in proper positions for permanent employees. outsourcing systems provide cost efficiencies for companies but also present challenges for worker protection. Different views were revealed from interviews with outsourcing workers and employer companies. Workers consider it to provide access to work even though the entrance fee is a burden. Companies see it as a cost and flexibility solution. In the UUCK, the abolition of outsourcing regulations leads to the loss of restrictions and protections for workers, such as
limits on the type of work and working time, resulting in lack of assurance and abuse. Government oversight is important to maintain a balance between business efficiency and worker protection.
