Abstract

Indonesian fishermen have been catching fish for generations since the 17th century. This has made Indonesian fishermen continue to fish in waters near Australia. But the changing times have made the country's territorial order and maritime boundaries change. Therefore, the result of these changes makes Indonesian fishermen often considered illegal fishing. While the purpose of the authors conducted this research, because the authors want to see about cross-border fishing that occurs in Australian waters. As well as the dynamics in the globalization era, fishermen must feel the effects of these changes. Where these changes certainly affect the economy and livelihood of the fishermen. In this case, the author uses the view of neo-liberalism theory because this theory is able to strengthen bilateral relations between Indonesia and Australia regarding the resolution of the problem. The theory of neo-liberalism is believed to be able to provide a strong understanding and insight regarding this case, This also led the writer to further examine the problems that occurred. In this study the authors used a qualitative method which means the authors only used data that had been proven to be true. Then the authors also use the FDG (Forum Discussion Group) activity as a seminar on maritime boundaries. The conclusion from the results that the authors get is that the two countries have mutually agreed on an agreement formed, namely the 1974 BOX MOU. Then Indonesian fishermen caught in Australian waters generally take action that is not in accordance with the agreement contained in the 1974 BOX MOU. / Nelayan Indonesia sudah melakukan penangkapan ikan secara turun – temurun sejak abad ke – 17. Hal tersebut yang membuat para nelayan Indonesia terus melakukan penangkapan ikan di wilayah perairan yang berdekatan dengan Australia. Namun perubahan zaman membuat tatanan wilayah negara beserta batas maritim mengalami perubahan. Oleh sebab itu akibat dari perubahan tersebut membuat para nelayan Indonesia sering dianggap melakukan tindakan illegal fishing. Sedangkan tujuan dari penulis melakukan penelitian ini, dikarenakan penulis ingin melihat mengenai penangkapan ikan lintas batas yang terjadi di wilayah perairan Australia. Serta dengan dinamika di era globalisasi membuat para nelayan harus merasakan dampak perubahan tersebut. Dimana perubahan tersebut tentu berpengaruh terhadap perekonomian maupun mata pencaharian para nelayan. Dalam kasus ini, penulis menggunakan pandangan teori neo – liberalisme dikarenakan teori ini mampu memperkuat hubungan bilateral Indonesia serta Australia mengenai penyelesaian permasalahan tersebut. Teori neo – liberalisme dipercaya mampu memberikan pemahaman serta pandangan yang kuat mengenai kasus ini, Hal tersebut juga yang membawa penulis untuk meneliti lebih jauh permasalahan yang terjadi. Dalam penelitian ini penulis menggunakan metode kualitatif yang artinya penulis hanya menggunakan data – data yang sudah terbukti kebenarannya. Kemudian penulis juga menggunakan kegiatan FDG (Forum Discussion Group) yaitu sebagai sebuah seminar mengenai batas maritim. Kesimpulan dari hasil yang penulis dapatkan bahwa kedua negara sudah saling menyetujui perjanjian yang dibentuk yaitu MOU BOX 1974. Kemudian para nelayan Indonesia yang tertangkap di wilayah perairan Australia umumnya melakukan tindakan yang tidak sesuai dengan perjanjian yang ada di dalam MOU BOX 1974.
