Abstract

The large potential of fisheries resources, weak supervision in border waters, high fish demand abroad and not yet optimal bilateral cooperation in handling illegal fishing, has encouraged the occurrence of illegal fishing activities in Indonesian waters. Illegal fishing that occurs in Indonesian waters is a serious problem that must be addressed not only by Indonesia alone. Stronger bilateral cooperation needs to be developed and implemented in practice by Indonesia and neighboring countries in the region, especially in Vietnam. Indonesia-Vietnam has the tendency to use economic partnership deals as part of its diplomacy to secure bilateral agreements and adapting the diplomatic approaches to minimize any upcoming negative impacts. The diplomatic approach is done through the economic partnership agreements that have been done in the past years by the Government of Indonesia and Vietnam. Bilateral relations of Indonesia-Vietnam have been diplomatically good, and the illegal fishing activities has not been significantly impacted both countries due to the economic cooperation that has been partnered in the past few years. Regional approaches through ASEAN could also be served as a forum to discuss, yet the principle of non-interference ‘forced’ the nations to uphold bilateral agreements. Multilateral approaches, such as the implementation of UNCLOS also should be ratified as the standards of regulations. Yet, the cooperation between Indonesia-Vietnam should still be implemented to combat illegal fishing issues within Indonesian waters. Potensi besar sumber daya perikanan, lemahnya pengawasan di perairan perbatasan, tingginya permintaan ikan di luar negeri dan belum optimalnya kerja sama bilateral dalam menangani penangkapan ikan ilegal, telah mendorong terjadinya kegiatan penangkapan ikan ilegal di perairan Indonesia. Penangkapan ikan ilegal yang terjadi di perairan Indonesia adalah masalah serius yang harus ditangani bukan hanya oleh Indonesia saja. Kerja sama bilateral yang lebih kuat perlu dikembangkan dan diimplementasikan dalam praktik oleh Indonesia dan negara-negara tetangga di kawasan ini, terutama Vietnam. Indonesia-Vietnam memiliki kecenderungan untuk menggunakan kesepakatan kemitraan ekonomi sebagai bagian dari diplomasi untuk mengamankan perjanjian bilateral dan mengadaptasi pendekatan diplomatik untuk meminimalkan dampak negatif yang akan datang. Pendekatan diplomatik dilakukan melalui perjanjian kemitraan ekonomi yang telah dilakukan dalam beberapa tahun terakhir oleh Pemerintah Indonesia dan Vietnam. Hubungan bilateral Indonesia-Vietnam telah baik secara diplomatik, dan kegiatan penangkapan ikan ilegal belum berdampak signifikan pada kedua negara karena kerja sama ekonomi yang telah bermitra dalam beberapa tahun terakhir. Pendekatan regional melalui ASEAN juga dapat berfungsi sebagai forum untuk membahas, namun prinsip non-campur tangan 'memaksa' negara-negara untuk menegakkan perjanjian bilateral. Pendekatan multilateral, seperti implementasi UNCLOS juga harus diratifikasi sebagai standar regulasi. Namun, kerja sama antara Indonesia-Vietnam masih harus dilaksanakan untuk memerangi masalah penangkapan ikan ilegal di perairan Indonesia.
