Abstract
For years, Malaysia has become the main destination for Indonesian labor migrants. However, the lack of protection from Indonesia and Malaysia leads to several cases of human rights violation experienced by Indonesian labor migrants. The negotiation between Indonesia and Malaysia was held as the means to establish a better protection system for Indonesian labor migrants. The goal of this research is to obtain a comprehensive description about the process of the negotiation between the government of Indonesia and Malaysia concerning Indonesian labor migrants. The analysis on the dynamics movement of negotiation from year to year is expected to provide the root of the long phases negotiation. Moreover, the analysis on the preliminary outcome of each negotiation is also provided to see the factors behind every decision. This research uses descriptive analysis method with qualitative approach. Concepts used are: negotiation in realism perspective (including the component within the negotiation such as: bargaining, escalation, de-escalation, and deadlocks) and national interests on Indonesian Labor migrants (as the reasons of the negotiation). The result of this research shows that the negotiation between Indonesia and Malaysia lies within three different meetings: annual consultation, ministry level meeting and Joint Working Group. These three meetings have significant contribution to the improvement of negotiation as they have different roles in completing the framework of policy making within a series of negotiations. The long phases of the negotiation occur as a result of national interest frictions in Indonesian labor migrants between the states. Moreover, the lack of coordination of Indonesian migration staff leads to a weak negotiation position for Indonesia and makes the negotiation run ineffectively due to the gap between Indonesia and Malaysia.
