Abstract

The Supreme Court Circular Letter 02/2023 on Guidelines for Settling Cases of Applications for Interfaith Marriage Dispensation has sparked controversy in Indonesian society. This thesis aims to analyze the implications of this SEMA on the legal practices on handling interfaith marriage in Indonesia. Data were collected through literature studies and expert interviews related to interfaith marriage. The results of the study show SEMA 02/2023 has significant implications for interfaith marriage in Indonesia including; reinforcing the prohibition of registration of interfaith marriages in Indonesia, making the process of applying for interfaith marriage dispensation more difficult and complicated. Increasing discrimination against couples who choose to exercise their right to marry despite their differences, threatening the human rights of couples who choose to exercise their right to marry despite the difference of their religion. This thesis recommends several steps to address the negative implications of SEMA 02/2023, including; revising the marriage law to explicitly recognize and protect interfaith marriage, urging the Supreme Court to revoke SEMA 02/2023, educating the public about the rights of couples who want to enter into interfaith marriage.
