Abstract

Indonesia is an archipelagic country with 1/3 of the land area and 2/3 of area is sea area. Indonesia has realized the potential of marine wealth that is rich in fish supply by maximizing the exploration and use of the fisheries resources within the nation’s territory. With its strategic geographical location surrounded by vast oceans and bordering with other countries, Indonesia is vulnerable to the illegal fishing carried out by foreign and domestic fisherman. Therefore, through the mandate that stated in both international and national laws, the Indonesian government has the right to implement sink the vessel policy as a sanction, and deterrent to the perpetrators of illegal fishing. During the four years of President Joko Widodo’s administration (2014-2018), Indonesia succeeded in sinking 488 illegal vessels that entered Indonesia waters. From the results of this study, it can be understood that the implementation of sink the vessel policy is a practice for the Republic of Indonesia to guarantee security and sovereignty of the nation state, as well as to protect the security of Indonesia’s territories. This research also provide that Indonesia has the capability in enforcing the law in the form of sinking illegal ships, and that policy does not affect good relations between Indonesia and other Southeast Asian countries. This fact is important in order for other countries to be aware about the boundaries that belong to Indonesia’s sovereign territory. Furthermore, the enforcing of this regulation is also to engage on any ki nd of activity that specifically violating the laws relating to fisheries and marine. / Indonesia merupakan negara kepulauan dengan 1/3 luasnya merupakan wilayah daratan dan 2/3 luasnya merupakan wilayah lautan. Indonesia telah merealisasikan potensi kekayaan laut sebagai negara yang kaya akan pasokan ikan, dengan memaksimalkan eksplorasi dan penggunaan sumber daya perikanan yang terkandung di wilayah laut Indonesia. Dengan letak geografis yang strategis di kelilingi oleh lautan luas dan berdampingan dengan wilayah perairan negara lain, Indonesia rentan terhadap ancaman pencurian ikan atau illegal fishing yang di lakukan oleh sekelompok atau individu nelayan yang berasal dari negara lain. Oleh karena itu, melalui amanat yang tertera dalam hukum dan peraturan nasional dan internasional, pemerintah Indonesia berhak untuk melakukan kebijakan penenggelaman kapal atau sink the vessel policy sebagai sanksi dan efek jera terhadap para pelaku illegal fishing. Dalam periode empat tahun pemerintahan Presiden Joko Widodo (2014-2018), Indonesia telah berhasil menenggelamkan kapal ilegal sebanyak 488 buah kapal yang masuk ke wilayah perairan Indonesia. Dari hasil penelitian ini, dapat di pahami bahwa dalam menerapkan sink the vessel policy adalah sebagai cara dari negara Republik Indonesia dalam menjaga keamanan serta kedaulatan negara, sekaligus untuk mencegah potensi gangguan keamanan di wilayah perairan Indonesia. Penelitian ini juga memberikan bukti bahwa Indonesia memiliki kapabilitas untuk menegakkan hukum dalam bentuk kebijakan sink the vessel dan kebijakan tersebut tidak memengaruhi hubungan baik antara Indonesia dengan negara-negara Asia Tenggara lainnya. Hal ini penting agar negara lain mengetahui batas-batas wilayah kedaulatan Indonesia sehingga mereka tidak melakukan aktivitas-aktivitas yang bertentangan dengan hukum khususnya yang menyangkut kelautan dan perikanan.
