Abstract

Medicine plays a very important role in a human's life. With medicine, it can eliminate diseases in the body. Therefore, various kinds of medicines have emerged from various companies or pharmacies that sell and buy these medicines. The role of the government and the Food and Drug Supervisory Agency (BPOM) is very necessary to guarantee the quality and quality of these medicines. However, it has been discovered that cough syrup containing Ethylene Glycol (EG) and Diethylene Glycol (DEG) contamination has exceeded the safe limit, which causes kidney failure in toddlers. This research aims to resolve legal problems by searching for and finding solutions related to applicable law. And the author uses a type of qualitative research, namely research regarding descriptive research, tends to use analysis, and uses legal materials as a reference. With actions and mistakes committed by business actors that endanger health, causing acute kidney failure in toddlers, the parents and families of these toddlers have to suffer losses, and weak supervision from BPOM also causes this case to occur. Therefore, it is necessary to increase consistency in monitoring the distribution of medicines by BPOM, and consumers have the right to adequate compensation, namely by providing compensation costs to victims. However, its implementation is still not in line with expectations, namely there is no real form of compensation for consumers who have been harmed.
