Abstract

Kediri District Court Decision Number 99/Pid.Sus/2023/PN Kdr, the panel of judges at the Kediri City District Court, sentenced four defendants who are high-ranking officials of the pharmaceutical company PT Afifarma to two years in prison each in a drug case. The syrup contains ethylene glycol. Business actors or producers have responsibility for what they produce or trade. Business actors carrying out their business cause losses, so business actors are responsible for the actions they carry out. This type of research uses normative juridical, using primary, secondary and tertiary legal materials with data collection methods carried out through library studies and documentation studies and using a case study approach and the nature of data analysis using deductive methods. The results of the discussion are, Regulation of business actors obligations in producing medicines is regulated in Food and Drug Supervisory Agency Regulation Number 34 of 2018 concerning Guidelines for Good Medicine Manufacturing Methods. Products produced by PT Afifarma do not meet or do not comply with the required standards and provisions of statutory regulations. invitation for not implementing the provisions on Good Medicine Manufacturing Practices by not testing for Ethylene Glycol and Diethylene Glycol contamination. the Decision of the Kediri District Court Number: 99/Pid.Sus/2023/PN.Kdr according to the Perspective of the Theory of Dignified Justice. With the decision, the defendants were only sentenced to 2 years in prison, which did not fulfill the objectives of the law itself, even though the aspect of legal certainty was fulfilled, the aspect of justice was and legal benefits are not fulfilled.
