Abstract
Penelitian ini menyelidiki pelindungan hukum terhadap data pribadi bagi pengguna dan non-pengguna aplikasi pendeteksi panggilan spam. Di era globalisasi, penggunaan telepon pintar yang semakin meningkat, yang menyimpan banyak data
pribadi dan menimbulkan risiko privasi yang signifikan. Studi ini mengkaji tanggung jawab aplikasi pendeteksi panggilan spam dalam menangani data pengguna, termasuk implikasi berbagi data dengan pihak ketiga. Penelitian ini
mengadopsi pendekatan hukum normatif, menganalisis kerangka hukum dan efektivitasnya di berbagai yurisdiksi, termasuk Indonesia, California, Nigeria, dan Uni Eropa. Studi ini mengungkapkan disparitas dalam regulasi perlindungan data
dan menyoroti perlunya langkah-langkah hukum yang komprehensif di Indonesia untuk melindungi data pribadi dari penyalahgunaan. Temuan utama menunjukkan bahwa sementara Uni Eropa dan California memiliki regulasi yang ketat, kerangka
hukum Indonesia masih kurang dalam ketentuan rinci untuk periklanan yang dipersonalisasi dan profil berdasarkan data pribadi. Studi ini menekankan pentingnya penerapan regulasi teknis yang jelas untuk memastikan kepastian hukum dan perlindungan efektif terhadap data pribadi. Penelitian ini menyimpulkan bahwa pengesahan Undang-Undang Nomor 27 Tahun 2022 tentang Perlindungan Data Pribadi (UU PDP) di Indonesia merupakan langkah penting untuk mengatur aktivitas pemrosesan data dan menegakkan akuntabilitas hukum. Namun,
pengembangan regulasi lebih lanjut diperlukan untuk menangani profil dan penggunaan data yang dipersonalisasi secara memadai. / This research investigates the legal protection of personal data for users and non users of spam call detection applications. In the era of globalization, the increasing use of smartphones, which store extensive personal data, poses significant privacy risks. This study examines the responsibilities of spam call detection applications in handling user data, including the implications of sharing data with third parties.The research adopts a normative legal approach, analyzing legal frameworks and their effectiveness in various jurisdictions, including Indonesia, California, Nigeria, and the European Union. The study reveals disparities in data protection
regulations and highlights the need for comprehensive legal measures in Indonesia to safeguard personal data against misuse. Key findings indicate that while the European Union and California have stringent regulations, Indonesia's legal
framework lacks detailed provisions for personalized advertising and profiling based on personal data. The study underscores the necessity for implementing clear technical regulations to ensure legal certainty and effective protection of personal data. The research concludes that the enactment of the Personal Data Protection Law (UU PDP) in Indonesia is a critical step towards regulating data processing activities and enforcing legal accountability. However, further regulatory developments are required to address profiling and personalized data usage adequately.
