Abstract
Penelitian ini menggunakan studi kasus yang membahas tentang keterangan palsu yang termuat dalam akta otentik. Berdasarkan Putusan Nomor 336 PK/Pdt/2017 PN Tng menyatakan bahwa Akta Jual Beli Nomor 86 dinyatakan batal demi hukum, karena dalam pembuatan Akta Kuasa Menjual Nomor 05 terdapat pemalsuan tanda tangan, sehingga tidak terpenuhinya syarat objektif dalam Pasal 1320 KUHPerdata yaitu syarat sah perjanjian. Sebagaimana dikaitkan dalam Pasal 1335 KUHPerdata yang menyatakan suatu perjanjian tanpa sebab atau yang telah dibuat karena sesuatu sebab yang palsu atau terlarang, tidak mempunyai kekuatan hukum dengan kata lain batal demi hukum. Demikian juga balik nama sertifikat HGB Nomor 795/Sukanagalih yang dibalik nama dari atas nama penggugat menjadi atas nama tergugat II dinyatakan tidak mempunyai kekuatan hukum. Berdasarkan hasil analisis, bahwa Notaris tidak memiliki kewajiban menyelidiki secara materiil mengenai kebenaran identitas dan keterangan yang diberikan para pihak, maka Notaris terbukti tidak melakukan tindak pidana pemalsuan akta dan notaris tidak dapat dimintai pertanggungjawaban terhadap akta yang dibuatnya. Notaris juga harus senantiasa menerapkan prinsip kehati-hatian dalam proses pembuatan akta otentik untuk menghindari keterangan yang tidak sebenarnya, pemalsuan data, identitas bahkan melakukan pemalsuan tanda tangan yang dilakukan oleh pihak yang menghadap ke Notaris, agar tidak terjadi kesalahan atau meminimalisir kesalahan untuk kedepannya. / This research uses a case study that discusses false information contained in authentic deeds. Based on Decision Number 336 PK/Pdt/2017 PN Tng stated that the Deed of Sale and Purchase Number 86 was declared null and void, because in the making of the Deed of Power of Attorney to Sell Number 05 there was a forged signature, so that the objective requirements in Article 1320 of the Civil Code, namely the conditions for the validity of the agreement, were not fulfilled. As related in Article 1335 of the Civil Code which states that an agreement without cause or which has been made for a false or prohibited reason, has no legal force, in other words it is null and void. Likewise, the name change of the HGB certificate Number 795/Sukanagalih which was changed from being in the plaintiff's name to being in the name of defendant II was declared to have no legal force. Based on the results of the analysis, that the Notary does not have the obligation to investigate materially regarding the truth of the identities and information provided by the parties, it is proven that the Notary has not committed the crime of forgery of deeds and the notary cannot be held responsible for the deeds he makes. Notaries must also always apply the principle of caution in the process of making authentic deeds to avoid false information, falsification of data, identity and even forgery of signatures made by parties appearing before the Notary, so that errors do not occur or minimize errors in the future.
