Abstract

Tanah merupakan modal penting Indonesia, pemerintah mengesahkan peraturan melalui Undang-Undang Nomor 5 Tahun 1960 tentang Pokok Agraria (UUPA). UUPA mengatur hak atas tanah termasuk hak milik eksklusif bagi warga negara Indonesia. Praktiknya Warga Negara Asing, menggunakan nominee arrangement untung mengakali pembatasan kepemilikan tanah di Indonesia, hal ini menyebabkan ketidakpastian hukum. Rumusan masalah dalam penelitian ini adalah untuk mengetahui kedudukan warga negara asing dalam kepemilikan hak atas tanah di Indonesia dalam menggunakan nominee arrangement dan kepastian hukum kepemilikan warga negara asing atas kepemilikan hak milik di Indonesia. Penelitian ini adalah penelitian normatif empiris, menggunakan pendekatan perundang- undangan,konseptual, kasus hukum serta analisis. Dari hasil penelitian tersebut, dapat disimpulkan bahwa Praktik ini melibatkan warga negara asing yang meminjam nama warga negara Indonesia untuk memperoleh Hak Milik atas tanah, yang secara hukum melanggar syarat perjanjian dan batal demi hukum. Berdasarkan ketentuan tentang sertifikat hak atas tanah sesuai Pasal 32 ayat (1) PP 24/1997, serta SEMA 10 Tahun 2020, sertipikat mencatat subjek hukum yang memiliki hak perdata yang sah atas tanah tersebut. Kepastian hukum mengenai kepemilikan hak atas tanah oleh warga negara asing telah diatur dalam UUPA bahwa dapat diberikan hak pakai dengan jangka waktu 30 tahun untuk pertama kali dan 20 tahun untuk perpanjangan serta 20 tahun untuk pembaruan hak dengan pembatasan berupa harga minimal sesuai dengan Keputusan ATR/KBPN Nomor 1241/SK/HK.02/IX/2022. / Land is an important asset in Indonesia, and the government regulates it through Law Number 5 of 1960 concerning Basic Agrarian Principles (UUPA). UUPA regulates land rights, including ownership rights exclusive to Indonesian citizens. However, foreigners often use nominee arrangements to circumvent land ownership restrictions in Indonesia, leading to legal uncertainty. The research aims to understand the position of foreigners in land ownership in Indonesia using nominee arrangements and the legal certainty of foreign ownership rights in Indonesia. This research is normative empirical research, using statutory, conceptual, legal case, and analytical approaches. The results indicate that this practice involves foreigners borrowing the names of Indonesian citizens to obtain ownership rights to land, which legally violates contract terms and is void by law. According to the provisions regarding land rights certificates as per Article 32 paragraph (1) of Government Regulation 24/1997, and SEMA 10 of 2020, the certificate records the legal subject with valid civil rights to the land. Legal certainty regarding land ownership by foreigners is regulated in the UUPA, which allows for the granting of usage rights with a term of 30 years for the first time, 20 years for the extension and 20 years for renewal of rights and minimum price restrictions according to ATR/KBPN Decree Number 1241/SK/HK.02/IX/2022.
