Abstract

Dalam prakteknya masih terjadi pembuatan dan penandatanganan sebuah perjanjian jual beli dibawah tangan atas tanah yang belum bersertifikat dilakukan oleh masyarakat. Tentu obyek tanah yang belum bersertifikat belum memberikan kepastian hukum ditinjau dari hukum pertanahan di Indonesia, khususnya pendaftaran tanah. Untuk itu rumusan masalah dalam penelitian ini adalah akibat hukum dan kepastian hukum perjanjian jual beli dibawah tangan terhadap tanah yang belum bersertipikat. Jenis penelitian yang digunakan adalah penelitian hukum bersifat yuridis-empiris melalui pendekatan peraturan perundang-undangan dan pendekatan kasus. Dari hasil penelitian tersebut, dapat disimpulkan bahwa akibat hukum perjanjian jual beli di bawah tangan terhadap jual beli hak atas tanah yang belum bersertipikat pada dasarnya kedudukan perjanjian tetap sah dan mengikat dengan memperhatikan ketentuan Pasal 1320 dan 1338 KUHPerdata. Kekuatan pembuktian perjanjian dibawah tangan adalah tidak sempurna, artinya para pihak dapat meragukan keabsahannya dalam pembuatan dan penandatanganan sehingga perjanjian tersebut wajib dibuktikan sebaliknya. Hal ini berbeda dengan dibuatnya suatu akta notaris. Kepastian hukum terkait perjanjian jual beli dibawah tangan terhadap tanah yang belum bersertipikat tetap mengikat bagi para pihak, akan tetapi tanah tersebut wajib untuk diakukan pendaftaran tanah, sehinga diterbitkannya sertipikat hak atas tanah, serta dibuat dan ditandatangani Akta Jual Beli yang dibuat oleh PPAT sebagai syarat dilakukannya pendaftaran tanah sesuai dalam Pasal 32 dan 37 ayat (1) Peraturan Pemerintah Nomor 24 Tahun 1997 tentang Pendaftaran Tanah dan memperhatikan asas terang dan tunai. / In practice, there are still occurrences where the community conducts private sale for land that has not been certified. Uncertified land does not provide legal certainty from the perspective of Indonesian land law, especially regarding land registration. Therefore, the formulation of the problem in this research is the legal consequences and legal certainty of private sale and purchase agreements for uncertified land. The type of research used is empirical juridical legal research through a statutory approach and a case approach. From the results of the research, it can be concluded that the legal consequences of private sale and purchase agreements for uncertified land rights are essentially that the agreements remain valid and binding, considering the provisions of Articles 1320 and 1338 of the Indonesian Civil Code (KUHPerdata). The evidentiary strength of private agreements is imperfect, meaning that the parties may question their validity in the drafting and signing, thus requiring the agreement to be proven otherwise. This is different from the creation of a notarial deed. The legal certainty regarding private sale and purchase agreements for uncertified land remains binding on the parties. However, the land must be registered to issue a land title certificate, and a Sale and Purchase Deed must be drafted and signed by a Land Deed Official (PPAT) as a requirement for land registration in accordance with Articles 32 and 37 paragraph (1) of Government Regulation Number 24 of 1997 concerning Land Registration, and taking into account the principles of transparency and cash.
