Abstract

Dilatarbelakangi oleh adanya praktek jual beli dengan objek hak atas tanah yang didahului dengan suatu perjanjian yang disebut dengan Perjanjian Pengikatan Jual Beli Hak atas Tanah (PPJB). PPJB merupakan suatu bentuk perjanjian sebelum dilaksanakannya jual beli hak atas tanah yang Dimana PPJB merupakan alat bukti tertulis yang bersifat autentik. Alat bukti tertulis bersifat autentik memberikan kepastian, ketertiban serta perlindungan hukum yang dibuat oleh/atau di hadapan pejabat yang berwenang. Setiap peristiwa hukum yang terjadi dicatat dan dituangkan secara tertulis dalam bentuk akta autentik sebagai alat bukti bagi para pihak bersangkutan ataupun dalam persidangan jika terjadi peristiwa yang tidak diinginkan. Namun dalam peristiwa hukum jual beli tanah terkadang terdapat penyangkalan-penyangkalan yang dilakukan oleh penjual ketika telah menerima sejumlah uang yang telah dilunaskan oleh pembeli dimana penjual tidak melakukan apa yang seharusnya disepakati di dalam perjanjian. Tulisan ini dimaksudkan untuk memperoleh jawaban atas rumusan permasalahan yang dikaji dalam penelitian ini pada pokoknya menyangkut peran notaris dalam memberikan perlindungan hukum bagi pihak pembeli berdasarkan akta perjanjian pengikatan jual beli yang tidak diakui oleh penjual. Metode penelitian yang digunakan adalah normatif. Hasil penelitian menunjukkan wujud peran Notaris dalam memberikan perlindungan hukum terhadap pembeli yakni dengan dibuatnya akta otentik oleh Notaris sesuai dengan apa yang ada di perundang-undangan sehingga akta otentik yang dibuat sesuai hukum yang berlaku merupakan suatu pembuktian yang sempurna sebagai alat bukti. / The background is the practice of buying and selling with the object of land rights which is preceded by an agreement called the Land Rights Binding Sale and Purchase Agreement (PPJB). PPJB is a form of agreement before the sale and purchase of land rights is carried out, where Purchase Agreement (PPJB) is Authentic written evidence. Authentic written evidence provides certainty, order and legal protection made by/or in the presence of an authorized official. Every legal event that occurs is recorded and stated in writing in the form of an authentic deed as evidence for the parties concerned or in court if an unwanted event occurs. However, in the legal event of buying and selling land, sometimes there is denials made by one of the parties when the seller have received the amount of money that has been paid by the buyer but the seller does not do what should have been agreed upon in the agreement. This article is intended to obtain answers to these formulation of the problems studied in this study principally concerns the role of a notary in providing legal protection for the buyer based on the deed of sale and purchase agreement which is not recognized by the seller. The research method used is normative. The research results show the form of the Notary's role in provide legal protection to buyers is to make an authentic written based on what is stated in notary of notary public and authentic written is a full evidentiary force.
