Abstract
Penelitian ini membahas pembatalan akta jual beli yang disebabkan oleh penyalahan keadaan oleh pihak ketiga, di mana akta jual beli sebagai dokumen legal yang mengesahkan perpindahan hak kepemilikan properti dapat dibatalkan jika terbukti adanya penyalahan keadaan yang mempengaruhi keputusan salah satu pihak dalam transaksi tersebut. Penyalahan keadaan terjadi ketika salah satu pihak dalam perjanjian berada dalam kondisi yang tidak seimbang atau tertekan secara ekonomi, sosial, atau psikologis, sehingga tidak memiliki kebebasan penuh dalam membuat keputusan, yang dimanfaatkan oleh pihak ketiga untuk mempengaruhi keputusan tersebut dan menghasilkan kesepakatan yang tidak adil atau merugikan.
Studi ini menganalisis kasus pembatalan akta jual beli di Indonesia dengan fokus pada identifikasi dan pembuktian penyalahan keadaan di pengadilan, menggunakan pendekatan yuridis normatif dan empiris, dan hasilnya menunjukkan bahwa
pengadilan dapat membatalkan akta jual beli jika terbukti adanya penyalahan keadaan oleh pihak ketiga, dengan pembuktian yang sering melibatkan analisis mendalam terhadap kondisi psikologis dan sosial pihak yang terlibat.
Kesimpulannya, penegakan hukum yang tegas dan perlindungan terhadap pihak yang rentan sangat penting untuk menjaga keadilan dan integritas hukum di Indonesia, serta edukasi hukum bagi masyarakat mengenai hak-hak mereka dalam transaksi properti dapat mencegah penyalahgunaan keadaan oleh pihak ketiga di masa depan. / This research discusses the cancellation of a sale and purchase deed caused by a third party misrepresenting the circumstances, where the sale and purchase deed as a legal document that validates the transfer of property ownership rights can be canceled if it is proven that there was a misrepresentation of circumstances that influenced the decision of one of the parties in the transaction. Mistakes occur when one of the parties to an agreement is in an unbalanced condition or is economically,
socially or psychologically depressed, so that they do not have full freedom in making decisions, which is exploited by a third party to influence the decision and produce an unfair or unfair agreement. harm. This study analyzes cases of
cancellation ofsale and purchase deeds in Indonesia with a focus on identifying and proving faulty circumstances in court, using a normative and empirical juridical approach, and the results show that the court can cancel a sale and purchase deed if it is proven that there was a fault in circumstances by a third party, with sufficient evidence. often involves in-depth analysis of the psychological and social conditions of the parties involved. In conclusion, strict law enforcement and protection of vulnerable parties is very important to maintain justice and legal integrity in Indonesia, and legal education for the public regarding their rights in propertytransactions can prevent abuse of the situation by third parties in the future
