Abstract
Insiden bayi tertukar merupakan insiden yang bersifat fatal dan seharusnya tidak boleh sampai terjadi. Insiden bayi tertukar kerap kali terjadi karena disebabkan oleh adanya kelalaian Tenaga Kesehatan dalam menjalankan kewajiban kehati- hatiannya (duty of care). Dalam hasil penelitian ditemukan bahwasanya insiden bayi tertukar umumnya terjadi karena tidak dilakukannya double check terhadap identitas bayi. Tidak dilakukannya double check terhadap identitas bayi merupakan suatu bentuk tindakan malapratik. Hal tersebut dapat dinyatakan demikian karena, tindakan malapraktik sejatinya merupakan kesalahan yang dilakukan oleh sumber daya manusia (SDM) kesehatan Rumah Sakit dalam melaksanakan profesinya yang tidak sesuai dengan standar profesi maupun standar prosedur operasional, yang mengakibatkan timbulnya kerugian maupun penderitaan bagi Pasien. Dalam perspektif hukum perdata, tindakan malapraktik termasuk dalam kategori perbuatan melawan hukum, namun perlu dibuktikan apakah tidak dilakukannya double check terhadap identitas bayi merupakan suatu perbuatan melawan hukum juga. Maka dari itu, dalam penelitian ini, akan dikaji lebih dalam mengenai implementasi unsur-unsur perbuatan melawan hukum terhadap tindakan malapraktik yang dilakukan oleh Tenaga Kesehatan tersebut, serta pertanggungjawabannya apabila ditinjau dari perspektif doktrin vicarious liability, dengan tujuan untuk memecahkan persoalan hukum terkait dengan tertukarnya bayi baru lahir akibat dari adanya tindakan malapraktik yang dilakukan oleh Tenaga Kesehatan Rumah Sakit dan menemukan proses penyelesaian sengketanya. Adapun jenis penelitian yang digunakan dalam hal ini adalah jenis penelitian hukum normatif-empiris yang bersifat analisis kualitatif, dengan menggunakan data sekunder dan data primer yang diperoleh melalui studi kepustakaan (library research) dan wawancara, lalu dianlisis menggunakan pendekatan terhadap sistematika hukum dan kasus hukum (case study). / Newborn swapped’s incident is a fatal incident and should not have happened. Newborn swapped’s incident often occur due to negligence by health workers in carrying out their duty of care. The research results found that newborn swapped’s incident generally occurred because a double check was not carried out on the baby's identity. Not doing a double check on the baby's identity is a form of malpractice. This can be stated as such because malpractice is actually an error committed by hospital's health human resources in carrying out their profession which is not in accordance with professional standards or standard operational procedures, which results in loss and suffering for Patients. From a civil law perspective, malpractice is included in the category of unlawful acts, but it needs to be proven whether not carrying out a double check on the baby's identity is also an unlawful act or not. Therefore, in this research, we will examine in more depth the implementation of the elements of unlawful acts regarding malpractice acts committed by health workers, as well as their responsibility when viewed from the perspective of the vicarious liability doctrine, with the aim of resolving legal issues related to the newborn swapped’s incident as a result of malpractice acts carried out by hospital health workers and finding a dispute resolution process. The type of research that used in this case is normative-empirical legal research which is qualitative analysis, using secondary data and primary data obtained through library research and interviews, then analyzed using an approach to legal systematics and legal cases study.
