Abstract
Notaris adalah pejabat publik yang berwenang untuk membuat akta otentik. Sebagai seorang pejabat publik, dalam menjalankan tugas dan tanggung jawabnya, notaris diwajibkan untuk menjaga kepentingan pihak yang terkait dalam akta notaris, namun, pada kenyataan praktinya notaris rentan untuk melakukan perbuatan yang melanggar undang-undang seperti dasarnya pelanggaran salah satunya yaitu pemalsuan akta otentik. sehingga akibat dari perbuatan Notaris tersebut menimbulkan kerugian terhadap pihak yang dirugikan dalam akta otentik. Maka, terhadap penghadap Notaris yang mengalami kerugian tersebut, diharuskan untuk dilindungi hak-haknya dengan adanya perlindungan hukum. Penelitian ini memiliki tujuan untuk mengetahui perlindungan hukum apa yang dapat diterima oleh Penghadap notaris yang dirugikan akibat pemalsuan akta otentik oleh Notaris serta untuk mengetahui kedudukan akta otentik yang dipalsukan oleh notaris. Penelitian yang penulis angkat yaitu menggunakan metode penelitian hukum normatif-empiris, dengan menggunakan pendekatan konseptual. Berdasarkan hasil penelitian dapat disimpulkan bahwa perlindungan hukum bagi penghadap yang dirugikan akibat dari pemalsuan akta otentik oleh notaris, yaitu penghadap dapat mengajukan gugatan ke pengadilan dengan dasar Perbuatan Melawan Hukum yang terdapat dalam Pasal 1365 KUHPerdata, dan kedudukan akta yang dipalsukan notaris, membuat akibat hukum terhadap akta otentik yang terbukti secara sah dipalsukan oleh Notaris, menjadi tetap sah atau batal demi hukum, tergantung dengan putusan pengadilan. / A notary is a public official who is authorized to make authentic deeds. As a public official, in carrying out his duties and responsibilities, the notary is obliged to safeguard the interests of the parties involved in the notarial deed, however, in practice notaries are vulnerable to committing acts that violate the law, such as the basic violation, one of which is falsifying authentic deeds. so that the consequences of the Notary's actions cause losses to the party injured in the authentic deed. So, those facing Notaries who experience such losses are required to have their rights protected with legal protection. This research aims to find out what legal protection can be received by a notary who is disadvantaged due to the forgery of an authentic deed by a notary and to find out the position of an authentic deed left behind by a notary as a result of an act of forgery by a notary. The author's research uses normative-empirical legal research methods, using a conceptual approach. Based on the results of the research, it can be concluded that legal protection for the party who suffers losses as a result of the forgery of an authentic deed by a notary, namely that the party can file a lawsuit in court on the basis of an Unlawful Act contained in Article 1365 of the Civil Code, and the position of the deed affected by the notary's forgery act, makes The legal consequences of an authentic deed that has been legally proven to be falsified by a Notary Public will remain valid or null and void, depending on the decision in court.
