Abstract
Dalam suatu Akta Perjanjian Pengikatan Jual Beli lazimnya diatur mengenai klausula kuasa mutlak, atau juga diatur dalam kuasa menjual yang merupakan satu kesatuan dengan Akta Pengikatan Jual Beli yang dibuat oleh Notaris memberikan kewenangan yang sama besarnya antara pembeli dengan penjual. Perlu dipahami bahwa penggunaan kuasa mutlak dapat menimbulkan konflik di kemudian hari, karena penggunaan kuasa mutlak dianggap bertentangan dengan peraturan perundang-undangan yang berlaku di Indonesia. Rumusan permasalahan yang dikaji dalam penelitian ini mengenai kedudukan klausula kuasa mutlak yang diperbolehkan dalam proses peralihan jual beli hak atas tanah serta kepastian hukum penggunaan klausula kuasa mutlak yang terkandung dalam Akta Pengikatan Jual Beli sebagai dasar peralihan hak atas tanah. Tujuan penelitian ini adalah untuk mengkaji dan menganalisa kedudukan klausula kuasa mutlak yang diperbolehkan dalam proses peralihan jual beli hak atas tanah. Metode penelitian yang digunakan adalah normatif empiris. Hasil penelitian menunjukkan bahwa penggunaan klausula kuasa mutlak dalam akta perjanjian pengikatan jual beli diperbolehkan sepanjang dibuat perjanjian itu telah sesuai dengan syarat sahnya perjanjian, objek perjanjian
telah lunas dan pokok-pokok dalam perjanjian telah dilaksanakan. Kepastian hukum penggunaan klausula kuasa mutlak yang terkandung dalam akta pengikatan jual beli lunas sebagai dasar peralihan hak atas tanah tidak termasuk sebagai kuasa mutlak yang dimaksud dalam Peraturan Pemerintah Nomor 24 Tahun 1997 tentang Pendaftaran Tanah sehingga kekuatan hukum dari akta pengikatan jual beli tersebut sangat kuat karena merupakan akta notariil yang bersifat akta otentik. / The Commitment of Sale and Purchase Agreement cannot actually be used as a basis that land rights have been transition, however, the absolute power of attorney clause in the power of sell contained in the Commitment of Sale and Purchase Agreement made by a Notary provides equal authority between the buyer and the seller. This is what often causes conflict in the future, because the use of absolute power of attorney is considered to be contrary to the prevailing laws and regulations in Indonesia. The formulation of problems studied in this research concerns the position of the absolute power of attorney clause which is permitted in the process of transition the sale and purchase of land rights and the legal certainty of the use of the absolute power of attorney clause contained in the Commitment of Sale and Purchase Agreement as a basis for transition of land rights. The aim of this research is to examine and analyze the position of the absolute power of attorney clause which is permitted in the process of transition the sale and purchase of land rights. The research method used is normative empirical. The results of the research show that the use of the absolute power of attorney clause in a Commitment of Sale and Purchase Agreement is permitted as long as the agreement is made in accordance with the conditions for the validity of the agreement, the object of the agreement has been paid off and the main points of the agreement have been implemented.
Legal certainty of the use of the absolute power of attorney clause contained in the Commitment of Sale and Purchase Agreement as a basis for the transition of land rights, it is not included as an absolute power of attorney as intended in the Government Regulation No. 24 of 1997 regarding Land Registration therefore the legal force of the Commitment of Sale and Purchase Agreement is very strong because it is a notarial deed which is an authentic deed.
