Abstract

Penelitian ini berfokus pada analisis Putusan Nomor 124/Pdt.G/2017/PN.Jkt.Sel, yang menyoroti penyalahgunaan wewenang dan perbuatan melawan hukum dalam praktik pembuatan akta jual beli oleh Pejabat Pembuat Akta Tanah (PPAT). Kasus ini melibatkan pemalsuan akta jual beli properti yang mengakibatkan kerugian materiil dan hilangnya hak atas properti tersebut. Penelitian ini bertujuan untuk menganalisis perbuatan melawan hukum yang dilakukan oleh PPAT dalam pembuatan akta cacat hukum, serta mengkaji bentuk pertanggungjawaban PPAT terhadap pembuatan akta yang mengandung cacat hukum. Penelitian ini menggunakan metode normatif-empiris dengan pendekatan peraturan perundang-undangan, konseptual, dan studi kasus. Hasil penelitian menunjukkan bahwa PPAT terbukti melakukan perbuatan melawan hukum dengan membuat akta jual beli palsu dan tidak melakukan pengecekan yang memadai terhadap keabsahan dokumen dan data yuridis. Akibatnya, hak milik atas tanah beralih secara tidak sah dan dibebani hak tanggungan. PPAT bertanggung jawab secara perdata, pidana, dan administratif atas perbuatannya. Penelitian ini memberikan kontribusi dalam memahami tanggung jawab PPAT dan implikasi hukum dari perbuatan melawan hukum dalam pembuatan akta cacat hukum. / This research focuses on the analysis of Decision Number 124/Pdt.G/2017/PN.Jkt.Sel, which highlights the abuse of authority and unlawful acts in the practice of making deeds of sale by Land Deed Making Officials (PPAT). This case involves the falsification of property sale and purchase deeds resulting in material losses and the loss of rights to the property. This study aims to analyze the unlawful acts committed by PPAT in making flawed deeds, as well as to examine the forms of PPAT accountability for making deeds that contain legal defects. This research uses a normative-empirical method with statutory, conceptual, and case study approaches. The results showed that PPAT was proven to have committed an unlawful act by making a fake sale and purchase deed and not conducting adequate checks on the validity of documents and juridical data. As a result, ownership of the land was transferred illegally and encumbered by a mortgage. PPAT is liable civilly, criminally, and administratively for his actions. This research contributes to understanding the responsibilities of PPAT and the legal implications of unlawful acts in making flawed deeds.
