Abstract
Pemerintah mengeluarkan peraturan baru yaitu Peraturan Pemerintah Nomor 18 Tahun 2021 mengenai keringanan agar WNA dapat dimudahkan apabila ingin memiliki hunian di Indonesia. Meskipun demikian, pemerintah memberikan batasan minimal harga hunian yang boleh dimiliki oleh wna namun, disisi lain peraturan ini memiliki kekosongan hukum pada bagian batasan jumlah unit kepemilikan yang boleh dimiliki oleh WNA dan tidak adanya sosialisasi oleh MPPD kepada PPAT mengenai peraturan baru yang berlaku sehingga pelaksanaan pembinaan dan pengawasan terhadap PPAT tidak efektif. Dalam penelitian ini pengumpulan data dilakukan dengan pendekatan perundang-undangan dan juga pendekatan kasus, dengan jenis penelitian hukum yuridis normatif, cara perolehan data secara studi perpustakaan. Dari hasil penelitian dapat disimpulkan bahwa tidak ada peraturan yang mengatur mengenai maksimal penambahan luas bidang tanah untuk rumah tapak dan batasan jumlah kepemilikan unit rumah susun yang boleh dimiliki oleh WNA di Indonesia, hal ini tentu menjadi urgensi karena mengingat bagaimanapun kepemilikan atas yang berdiri ditanah Indonesia milik warga negara Indonesia agar tidak dikuasai oleh WNA, dan Majelis Pembina dan Pengawas PPAT memiliki peran krusial dalam memastikan bahwa PPAT menjalankan tugas mereka sesuai dengan hukum dan etika profesi, dengan demikian Majelis Pembina dan Pengawas PPAT berperan penting dalam menjaga keteraturan dan kepatuhan dalam sektor properti di Indonesia. / The government issued a new regulation, namely Government Regulation Number 18 of 2021, which aims to ease the process for foreigners to own housing in Indonesia. However, the government has set a minimum price limit for properties that can be owned by foreigners. On the other hand, this regulation lacks legal provisions regarding the maximum number of housing units that foreigners can own and there has been no socialization by the MPPD to the PPAT regarding the new regulation. Consequently, the guidance and supervision of PPAT are not effective. In this study, data was collected using legislative and case approaches, with the type of legal research being normative juridical and data obtained through library research. The research results concluded that there are no regulations governing the maximum addition of land area for landed houses and the limit on the number of apartment units that foreigners can own in Indonesia. This issue is urgent because ownership of land in Indonesia should remain with Indonesian citizens to prevent control by foreigners. The PPAT Supervisory and Guidance Board plays a crucial role in ensuring that PPAT perform their duties in accordance with the law and professional ethics, there by maintaining order and compliance in the property sector in Indonesia.
