Abstract
Akta yang dibuat oleh notaris dapat menjadi sebuah alas hukum atas suatu perbuatan hukum tertentu, termasuk salah satunya ialah perbuatan hukum jual-beli. Jual beli diartikan sebagai suatu perjanjian, dimana pihak yang satu mengikat dirinya untuk menyerahkan suatu kebendaan dan pihak yang lain mengikat dirinya untuk membayar harga yang telah dijanjikan. Pada dasarnya setiap perjanjian yang telah disepakati bersama wajib dijalankan dengan itikad baik. Namun, pada praktiknya masih terdapat banyak pihak membuat perjanjian dengan itikad buruk dan tidak menjalankan kewajiban sebagaimana telah disepakati bersama. Penelitian ini bertujuan untuk menganalisis dan mengetahui tanggung jawab pembeli atas perbuatan wanprestasi dalam pelaksanaan perjanjian serta akibat hukum atas akta notaris terkait adanya perbuatan wanprestasi yang dilakukan oleh pembeli. Penulis dalam penelitian ini menggunakan metode penelitian hukum normatif dengan mengkaji permasalahan hukum dimana aturan perundangan menjadi acuan dari kondisi yang seharusnya (das sollen) serta menggunakan pendekatan empiris dalam menganalisis kasus mengenai kenyataan hukum. Hasil penelitian diperoleh bahwa pembeli wajib untuk memberikan penggantian biaya kepada penjual sebagaimana diatur dalam Pasal 1239 KUH Perdata, yaitu bila melakukan wanprestasi, pihak yang lalai harus memberikan penggantian berupa biaya, kerugian, dan bunga. Sementara itu, akibat hukum atas akta notaris terkait adanya perbuatan wanprestasi ialah akta tetap sah menjadi sebuah akta otentik karena telah memenuhi syarat sah suatu akta sebagaimana diatur dalam Pasal 1868 KUHPerdata serta perjanjian jual-beli antara penjual dan pembeli tetap dikatakan sah karena telah memenuhi syarat perjanjian sebagaimana diatur dalam Pasal 1320 KUHPerdata. / Deed made by a notary can become a legal basis for certain legal acts, including one of the legal acts of buying and selling. Buying and selling is defined as an agreement, where one party binds himself to hand over an object and the other party binds himself to pay the price that has been promised. Basically, every agreement that has been mutually agreed upon must be carried out in good faith. However, in practice there are still many parties who make agreements in bad faith and do not carry out their obligations as mutually agreed upon. This research aims to analyze and determine the buyer's responsibility for acts of default in implementing the agreement as well as the legal consequences of notarial deeds related to acts of default committed by the buyer. The author in this research uses normative legal research methods by studying legal problems where statutory regulations are a reference for conditions that should be (das sollen) and uses an empirical approach in analyzing cases regarding legal reality. The research results show that the buyer is obliged to provide reimbursement for costs to the seller as regulated in Article 1239 of the Civil Code, namely that if there is a default, the negligent party must provide compensation in the form of costs, losses and interest. Meanwhile, the legal consequences of a notarial deed related to an act of default are that the deed remains valid as an authentic deed because it has fulfilled the legal requirements for a deed as regulated in Article 1868 of the Civil Code and the sale and purchase agreement between the seller and the buyer is still said to be valid because it has fulfilled the terms of the agreement. as regulated in Article 1320 of the Civil Code.
