Seiring perkembangan teknologi, kekonvensionalitasan dan modernitas selalu menjadi perdebatan secara khusus dalam perkembangan dunia Notaris, karena mayoritas daripada pelaksanaan profesi jabatan notaris sangat-sangat mengedepankan kekonvensionalitasan pelaksanaan jabatan notaris. Di satu sisi modernitas memberikan teknologi-teknologi yang dapat mendukung atau menunjang profesi jabatan notaris seperti tanda tangan elektronik dan meterai elektronik, sehingga dengan sifat kekonvensionalitasan tersebut dalam hal membuat akta notaris (akta otentik) memerlukan pengaturan-pengaturan lebih lanjut daripada aturan yang sebelumnya. Dengan adanya teknologi-teknologi tersebut maka muncul permasalahan lainnya khususnya dengan kerahasiaan jabatan notaris karena terdapatnya resiko-resiko lebih lanjut daripada penggunaan tanda tangan elektronik dan meterai elektronik pada suatu akta notaris (akta otentik). Dalam penelitian ini menggunakan metode Penelitian Normatif-Empiris yang menggabungkan metode normative dan empiris bersamaan. Sehingga pertanyaan yang dapat diajukan adalah mengenai Bagaimana penerapan pelaksanaan jabatan notaris berkaitan dengan tanda tangan elektronik dan meterai elektronik dikaitkan dengan peraturan jabatan notaris serta Bagaimana kajian terkait dengan kerahasiaan jabatan notaris berdasarkan peraturan jabatan notaris dikaitkan dengan penggunaan tanda tangan elektronik dan meterai elektronik. Penulisan ini bertujuan untuk mengetahui perbedaan dari penggunaan tanda tangan elektronik dan meterai elektronik serta solusinya atas dampak-dampak dari pengunaannya. / As technology develops, conventionality and modernity become a particular debate in the development of the world of notaries, because notary professions prioritize the conventionality of carrying out notarial positions. Modernity provides technologies that can support or support the profession of notary, such as electronic signatures and electronic seals, so that with this conventional nature, making notarial deeds (authentic deeds) requires further regulations than the previous regulations. With the existence of these technologies, other problems arise, especially about confidentiality of a notary's position because there are further risks from using electronic signatures and electronic seals in a notarial deed (authentic deed).So the questions being asked are regarding how the implementation of the notary position regarding electronic signatures and electronic seals is related to the notary position regulations and how confidentiality of notary positions work based on notary position regulations related to the use of electronic signatures and electronic seals. In this writing, author used a type of research called Normative-Empirical Legal Research which is a non-judicial case study (so it has no connection with the courts). This type of research is research which combines a normative legal approach with empirical research regarding the implementation of normative legal provisions (legislation). This research aim to find differences of using electronic signature and electronic stamp in notary deeds and solution for impact of use of such technology.
