Abstract

The registration of transferring land rights due to inheritance the heirs to one of the subjected inheritors based on the provisions in Article 42 paragraph (4) of PP 24/1997, in conjunction with Article 111 paragraphs (3) and (5) of PMNA 16/2021, is reliable to be submitted by using the Deed of Inheritance Distribution, either it is privately made or officially certified by a Notary. However, in its implementation at the Badan Pertanahan Nasional Land Office (BPN Land Office), it is found that not all inherited transfers of land rights can use the Deed of Inheritance Distribution, especially those deeds are privately made. There is a tendency that submissions of the Deed of Inheritance Distribution made by a Notary or the Deed of Land Common Right Distribution are acceptable. Therefore, the issue is raised in this study related with the provisions regarding the registration of transferring land rights due to inheritance based on the Deed of Inheritance Distribution according to applicable laws and regulations, as well as the authority of the BPN Land Office over a provision in the field of land, especially regarding the implementation of transfers of land rights due to inheritance using the Deed of Inheritance Distribution. This study uses a normative-empirical research method conducted by collecting legal materials as secondary data through literature studies. These secondary data are also reinforced with primary data obtained through interviews with officials from the BPN Land Office, which are then analyzed qualitatively. The results of this analysis indicate that the implementation of transferring land rights due to inheritance, especially those subjected inheritors, is reliable to be submitted by using the Deed of Inheritance Distribution, either it is privately made or officially certified, and the recording of transferring rights is applied to the respective inheritor. Regarding this matter, the BPN Land Office should not need to interpret an assumption that is clearly regulated to avoid being inconsistently implemented by each BPN Land Office, thus it the legal certainty in registering the inheritance transfer of land rights is ensured. / Pendaftaran peralihan hak atas tanah karena pewarisan yang ditujukan kepada salah satu ahli waris sebagai penerima warisan berdasarkan ketentuan dalam Pasal 42 ayat (4) PP 24/1997 jo. Pasal 111 ayat (3) dan (5) PMNA 16/2021 dimungkinkan untuk diajukan dengan menggunakan Akta mengenai Pembagian Waris (APW), baik yang dibuat di bawah tangan maupun yang dibuat dengan akta Notaris. Namun, pada pelaksanaannya di Kantor Pertanahan Badan Pertanahan Nasional (Kantah BPN), tidak semua peralihan hak atas tanah karena pewarisan dapat menggunakan APW, khususnya APW yang dibuat di bawah tangan. Terdapat kecenderungan pengajuannya hanya dapat menggunakan APW yang dibuat oleh Notaris atau dengan menggunakan APHB. Oleh karena itu, permasalahan yang diangkat dalam penelitian ini berkaitan dengan ketentuan mengenai pendaftaran peralihan hak atas tanah karena pewarisan berdasarkan APW menurut peraturan perundang-undangan yang berlaku serta mengenai kewenangan Kantah BPN terhadap suatu ketentuan dalam bidang pertanahan, khususnya terkait dengan pelaksanaan peralihan hak atas tanah karena pewarisan yang menggunakan APW. Penelitian ini menggunakan jenis penelitian normatif-empiris yang dilakukan dengan cara mengumpulkan bahan-bahan hukum sebagai data sekunder melalui studi kepustakaan. Data sekunder tersebut juga diperkuat dengan data primer yang didapatkan melalui wawancara dengan pejabat Kantah BPN untuk selanjutnya dianalisis secara kualitatif. Hasil analisis ini adalah pelaksanaan peralihan hak atas tanah karena pewarisan, khususnya yang ditujukan kepada satu penerima warisan dapat diajukan dengan menggunakan APW, baik yang dibuat di bawah tangan maupun yang dibuat dengan akta Notaris dan pencatatan peralihan haknya dilakukan kepada penerima warisan yang bersangkutan. Adapun terhadap hal tersebut, seharusnya pihak Kantor Pertanahan Badan Pertanahan Nasional tidak perlu menafsirkan suatu hal yang sudah dengan jelas diatur agar tidak menimbulkan ketidakseragaman pada pelaksanaan di masing-masing Kantor Pertanahan Badan Pertanahan Nasional sehingga kepastian hukum pelaksanaan pendaftaran peralihan hak atas tanah karena pewarisan dapat terwujud.
