Abstract

Since 2009 in Indonesia, has been implemented as one of the important requirements for the validity of business contracts carried out by economic actors, especially those dealing with foreign parties. This provision of course really respects the culture and honor of the Indonesian nation, which is very plural and consists of hundreds of ethnic groups. and hundreds of local languages, so that apart from the economic aspect, language is also a tool that unites the Indonesian nation. The Supreme Court as the highest judicial institution in Indonesia has the authority to correct any decisions that are incorrect in terms of the application of the law in every judicial decision subordinate to it, and since 2019 the Supreme Court judges at the cassation level have enforced the provisions governing the obligation to use Indonesian in business transactions, especially those related to foreign parties, contracts that only use foreign languages and do not use Indonesian in Indonesian territory are contrary to public order and legislation and are null and void by law. This has been proven by the Indonesia Supreme Court's decision which has permanent legal force. such cases, but the Supreme Court as an institution has made 3 Judgements in cassation level, however based on Circular letter from Indonesia Supreme of court (SEMA), this fact has canceled by the SEMA, therefore there has been an inconsistency with the judiciary and the applicable regulations, because The author adopted the title of this thesis as the title and conducted normative juridical research on the views of the Indonesian judiciary with the provisions of the applicable regulations governing the obligation to use Indonesian in contracts, especially those relating to foreign parties and Indonesian private institutions. / Di Indonesia sejak tahun 2009 telah memberlakukan Bahasa Indonesia sebagai salah satu syarat yang penting dalam sahnya kontrak bisnis yang dilakukan para pelaku ekonomi khususnya yang berhubungan dengan pihak asing, ketentuan ini tentunya sangat menghormati budaya dan kehormatan bangsa Indonesia yang sangat plural dan terdiri dari ratusan suku dan ratusan bahasa daerah, sehingga selain aspek ekonomi, bahasa juga merupakan alat yang mempersatukan bangsa Indonesia. Mahkamah Agung selaku lembaga tertinggi dan puncak peradilan di Indonesia berwenang untuk mengoreksi setiap putusan yang tidak benar secara penerapan hukum dalam setiap putusan peradilan yang berada dibawahnya, dan sejak tahun 2019 hakim Agung Mahkamah Agung di Tingkat kasasi telah menegakkan ketentuan yang mengatur kewajiban penggunaan Bahasa Indonesia dalam transaksi bisnis khususnya yang berhubungan dengan pihak Asing, kontrak yang hanya menggunakan Bahasa Asing dan tidak menggunakan Bahasa Indonesia dalam wilayah Indonesia bertentangan dengan ketertiban umum dan perundangundangan dan batal demi hukum hal ini telah dibuktikan dengan adanya putusan Mahkamah Agung yang telah berkekuatan hukum tetap memutus perkara yang demikian, namun Mahkamah Agung selaku kelembagaan telah membuat Surat Edaran Nomor. 3 Tahun 2003, dimana salah satu ketentuannya menyakatan bahwa kontrak yang berbahasa asing dibuat di Indonesia oleh lembaga swasta Indonesia dan perseorangan Indonesia dengan pihak asing tidak menjadi alasan untuk pembatalan kontrak tersebut, maka dengan demikian telah terjadi inkonsistensi badan peradilan dan peraturan yang berlaku, oleh karena itu penulis mengangkuat judul tesis ini sebagai judul dan melakukan penelitian secara juridis normatif atas pandangan peradilan Indonesia dengan ketentuan peraturan yang berlaku mengatur kewajiban penggunaan Bahasa Indonesia dalam kontrak khususnya yang berhubungan dengan Pihak Asing dengan lembaga swasta Indonesia.
