Abstract
Tujuan dilakukannya penelitian ini adalah untuk membahas salah satu merek terkenal yang
terjadi di Indonesia yaitu sengketa antara Starbucks Corporation dengan PT. Sumatra Tobacco
Trading Company sesuai dengan Nomor 51/Pdt.Sus/Merek/2021/PN Niaga Jkt.Pst, Tujuan
dilakukan penelitian ini adalah untuk mengetahui bagaimana analisa hukum terhadap sengketa
penggunaan kata “Starbucks” pada trade mark terkenal dan untuk mengetahui bagaimana
penyelesaiaan hukum terhadap pemegang hak merek penggunaan kata “Starbucks” di trade
mark terkenal pada studi Nomor 51/Pdt.Sus/Merek/2021/PN Niaga Jkt.Pst. Metode penelitian
yang digunakan dalam penelitian tugas akhir ini adalah hukum normatif. Penulis akaan
memahami dan menganalisis Nomor 51/Pdt.Sus/Merek/2021/PN Niaga Jkt.Pst dan
menggunakan bahan sekunder atau bahan kepustakaan untuk lebih memperluas pembahasan
dalam penelitian ini. Analisis dalam penelitian ini bersifat kualitatif. Sumber data peneliti
didapat dari bahan kepustakaan berupa direktori putusan mahkamah agung, serta bahan
kepustakaan lainnya. Hasil penelitian yang penulis dapatkan ialah dibatalkannya merek
Starbucks kelas 34 milik PT. Sumatra Tobacco Trading Company (STTC) yang didaftarkan atas
dasar itikad tidak baik, Tergugat memiliki niat untuk meniru, menjiplak atau mengikuti merek
pihak lain demi kepentingan usahanya yang dapat menimbulkan kondisi persaingan usaha tidak
sehat, mengecoh atau menyesatkan konsumen dan terbukti mempunyai persamaan pada
pokoknya dengan merek milik Starbucks Company sehingga merek Starbucks milik PT.
Sumatra Tobacco Trading Company harus dibatalkan demi hukum. Merek Starbucks Coffee
milik Starbucks Corporation juga dinyatakan sebagai merek terkenal yang sudah mendunia dan
merupakan yang pertama kali mendaftarkan merek “Starbucks”, dimana seharusnya mendapat
jaminan perlindungan hukum. Hal tersebut menunjukkan pelaksanaan dari perlindungan
represih sudah cukup baik. Namun, pelaksanaan dari perlindungan preventif belum maksimal
dikarenakan Dirjen KI yang belum teliti dalam menerima permohonan pendaftaran merek,
mengingat dalam pasal 21 UU MIG dikatakan bahwa permohonan pendaftaran merek akan
ditolak jika memiliki persamaan pada pokoknya dengan merek terdaftar dan/atau terkenal. Maka
dari itu, Dirjen KI perlu meningkatkan ketelitian dalam menerima permohonan pendaftaran
merek dan harus mensosialiasikannya kepada masyarakat luas akan pentingnya pemahaman
terhadap Hak Kekayaan Intelektual khususnya Hak Merek.

pokoknya, Itikad tidak baik. / The purpose of this research is to discuss one of the well-known brands that occurred in
Indonesia, namely the dispute between Starbucks Corporation and PT. Sumatra Tobacco
Trading Company in accordance with Number 51/Pdt.Sus/Merek/2021/PN Niaga Jkt.Pst, the
purpose of this research is to find out how the legal analysis of the dispute over the use of the
word "Starbucks" in a famous trade mark is and to find out how it is resolved law against brand
rights holders using the word "Starbucks" in famous trade marks in the study of Number
51/Pdt.Sus/Merek/2021/PN Niaga Jkt.Pst. The research method used in this research is
normative law. The author will understand and analyze the Number 51/Pdt.Sus/Merek/2021/PN
Niaga Jkt.Pst and use secondary materials or library materials to further expand the discussion
in this study. Sources of research data obtained from library materials in the form of directory
of the Supreme Court, followed by other library materials. The results of the research that the
author got were the cancellation of the brand owned by PT. Sumatra Tobacco Trading Company
which was registered on the basis of bad faith, In registering his trademark, the Defendant had
the intention to imitate, plagiarize or follow another party's trademark for the sake of his
business interests, which could create conditions for unfair business competition, deceive or
mislead consumers. and is proven to have similarities in principle with the trademark owned by
Starbucks Company so that the Starbucks brand owned by PT. Sumatra Tobacco Trading
Company must be canceled by law. The Starbucks Coffee brand owned by Starbucks
Corporation is also declared as a well-known brand, which should be guaranteed legal
protection. This shows that the implementation of repressive protection is quite good. However,
the implementation of preventive protection has not been maximized because the Director
General of Intellectual Property Rights has not been thorough in accepting applications for
registration of marks, bearing in mind that Article 21 of the MIG Law states that applications
for registration of marks will be rejected if they have similarities in principle with registered
and/or well-known marks. Therefore, the Director General of Intellectual Property Rights needs
to improve accuracy in receiving applications for registration of marks and must socialize them
to the wider community about the importance of understanding Intellectual Property Rights,
especially Trademark Rights.
