Abstract

At this time, the development of globalization has encouraged a lot of migration, making violations of the rights of migrant workers also occur. Concern over the many cases of violations of workers' rights is not only felt by large countries, but also other countries such as Indonesia and the Philippines. At the ASEAN level, Indonesia and the Philippines are the largest sending countries of labor to countries such as Malaysia and Singapore. Therefore, this study aims to identify and describe any violations of the rights that occur in Indonesian and Filipino migrant workers and explain the efforts made by the Governments of Indonesia and the Philippines in tackling the issue of workers' rights. This research is based on the theory of Liberalism with the concept of migrant workers, fulfillment of rights, and a regional framework. The research methodology used is descriptive method with a qualitative approach. The results of this study indicate that there are violations committed against migrant workers from Indonesia and the Philippines, with violations such as physical violence and nonphysical, to unpaid salary. The Governments of Indonesia and the Philippines have endeavored to carry out bilateral and multilateral cooperation implemented with ASEAN member countries. However, the results of the cooperation carried out by the Government of Indonesia and the Government of the Philippines have not produced the expected results and the two governments still have to make more efforts to address the rights of migrant workers in their countries. / Pada saat ini, perkembangan globalisasi telah mendorong banyaknya migrasi, sehingga pelanggaran akan hak pekerja migran juga marak terjadi. Keprihatinan terhadap banyaknya kasus pelanggaran hak pekerja ini tidak hanya dirasakan oleh negara-negara besar saja, tetapi juga menjadi perhatian negara-negara lain seperti Indonesia dan Filipina. Di tingkat ASEAN, Indonesia dan Filipina menjadi negara pengirim tenaga kerja ke luar negeri terbanyak ke negara-negara seperti Malaysia dan Singapura. Oleh karena itu, penelitian ini bertujuan untuk mengidentifikasi dan menggambarkan pelanggaran hak apa saja yang terjadi pada pekerja migran Indonesia dan Filipina serta menerangkan upaya yang dilakukan oleh Pemerintah Indonesia dan Filipina dalam menanggulangi masalah hak pekerja. Penelitian ini berlandaskan pada teori Liberalisme dengan konsep pekerja migran, pemenuhan hak, serta kerangka regional. Metodologi penelitian yang digunakan adalah metode deskriptif dengan pendekatan kualitatif. Hasil penelitian ini menunjukkan bahwa terdapat pelanggaran yang dilakukan kepada pekerja migran asal Indonesia dan Filipina, dengan bentuk pelanggaran seperti kekerasan fisik dan nonfisik, hingga tidak dibayarnya gaji mereka. Pemerintah Indonesia dan Filipina telah berupaya untuk melaksanakan kerja sama bilateral dan multilateral yang dilaksanakan dengan para negara anggota ASEAN. Namun, hasil dari kerja sama yang dilakukan oleh Pemerintah Indonesia dan Pemerintah Filipina belum membuahkan hasil yang diharapkan dan kedua pemerintah masih harus berupaya lebih lagi untuk menanggulangi permasalahan hak pekerja migran di negaranya.
