Batam Island, located between Malacca Strait and Singapore is an island whose high economic and tourism values. As the amount of ferry passengers and tourists traveling from Batam to Singapore or vice versa arises, Batam Industrial Development Authority decided to develop and manage a protection for them, by enclosing life insurance for all the ferry passengers on 1990. But the existence of The Act Number 5 Year 1999 concerning Prohibition of Monopolistic Practices and Unfair Business Competition invites a conflict to arise, regarding the agreement made between ferry passenger’s life insurance companies and Batam Industrial Development Authority. On 2009, Indonesian Competition Commission received a report from The Complainant reporting a disadvantage, related to a violation of The Act Number 5 Year 1999 by Batam Industrial Development Authority and some insurance companies. It is to be noted that Batam Industrial Development Authority and the reported insurance companies have the mandate or the rights given by the Indonesian government to manage the life insurance for Batam’s ferry terminal passengers. Therefore, the purpose of this legal research is to analyze the fact of the case, the authority or the rights of both Complainant and Defendant, the arguments of both parties, also the final and binding verdict of this case. The result of this legal research will elaborate the rights of Batam Industrial Development Authority in managing the ferry passenger’s insurance and also to reveal the barriers and challenges show up during the managerial
