Abstract

Perjanjian Kredit melalui Bank dilanjutkan dengan pendaftaran Hak Tanggungan diperlukan oleh masyarakat dalam hal untuk menjamin peminjaman uang. Tujuan dari penelitian ini adalah untuk mengetahui mekanisme perjanjian kredit yang dibuat oleh Notaris, untuk mengetahui peran Pejabat Pembuat Akta Tanah (PPAT) dalam pembuatan Akta Pemberian Hak Tanggungan (APHT) dan untuk mengetahui kendala yang dihadapi Notaris dalam pembuatan perjanjian kredit. Metode penelitian yang digunakan adalah penelitian hukum normatif empiris, yang menggunakan data sekunder yang diperoleh dari studi kepustakaan. Teknik pengumpulan data dilakukan dengan studi dokumen didukung dengan hasil wawancara dari narasumber yang berkaitan dengan topik permasalahan. Penelitian ini menggunakan pendekatan normatif dengan memahami buku-buku dan peraturan perundang-undangan serta dokumen-dokumen lain. Teknik analisis data yang digunakan adalah analisis secara kualitatif. Hasil penelitian yang diperoleh pada penulisan ini, yang pertama mekanisme perjanjian kredit yang dibuat oleh Notaris dalam rangka melindungi para pihak dalam hubungan hukum antara kreditur dengan debitur dimulai dengan adanya offering letter atau surat penawaran order pekerjaan notaris dari bank, selanjutnya notaris meminta dokumen kelengkapan berkas yang menjadi substansi dalam perjanjian kredit. Pada saat waktu yang ditentukan, maka notaris bersama para pihak melakukan penandatanganan akta perjanjian kredit. Setelah seluruh proses penandatanganan selesai, maka notaris memberikan covernote; selanjutnya notaris akan menarik kembali covernote dan memberikan tanda terima yang baru yang menyatakan bahwa seluruh berkas yang telah diterima notaris telah dikembalikan kepada bank. Kedua, peran Pejabat Pembuat Akta Tanah (PPAT) dalam pembuatan Akta Pemberian Hak Tanggungan (APHT) antara lain: melaksanakan pengecekan sertifikat di Kantor Badan Pertanahan Nasional (BPN), memeriksa keaslian dokumen pendukung, selanjutnya mempersiapkan SKMHT atau APHT untuk ditandatangani oleh para pihak yaitu Bank (Kreditur) dan Nasabah (Debitur); selanjutnya mendaftarkan APHT ke BPN, setelah Sertifikat Hak Tanggungan selesai Notaris dan PPAT menyerahkannya kepada Bank (Kreditur). Ketiga, kendala yang dihadapi Notaris dalam pembuatan perjanjian kredit diantaranya adalah kendala yang berasal dari debitur maupun objek Hak Tanggungan. Kendala lain berasal dari BPN, yaitu lambatnya proses pendaftaran Hak Tanggungan, meskipun berkas-berkas pendukung telah lengkap. / Credit agreements through banks followed by registration of mortgage rights are required by the community in order to guarantee borrowing money. The purpose of this research is to find out the mechanism of credit agreements made by Notaries, to find out the role of Land Deed Making Officials (PPAT) in making Deeds of Granting Mortgage Rights (APHT) and to find out the obstacles faced by Notaries in making credit agreements. The research method used is empirical normative legal research, which uses secondary data obtained from literature studies. The data collection technique was carried out using document studies supported by the results of interviews from sources related to the problem topic. This research uses a normative approach by understanding books, statutory regulations and other documents. The data analysis technique used is qualitative analysis. The results of the research obtained in this writing, the first is that the credit agreement mechanism made by a Notary in order to protect the parties in the legal relationship between the creditor and the debtor begins with an offering letter or an offer letter for a notarial job order from the bank, then the notary asks for the complete documents required. be the substance of the credit agreement. At the specified time, the notary and the parties sign the credit agreement deed. After the entire signing process is complete, the notary provides a covernote; Next, the notary will withdraw the covernote and provide a new receipt stating that all files received by the notary have been returned to the bank. Second, the role of the Land Deed Drafting Officer (PPAT) in making the Deed of Granting Mortgage Rights (APHT) includes: carrying out certificate checks at the National Land Agency (BPN) Office, checking the authenticity of the supporting documents, then preparing the SKMHT or APHT to be signed by the parties, namely Bank (Creditor) and Customer (Debtor); Next, register the APHT with BPN, after the Mortgage Certificate is completed, the Notary and PPAT submit it to the Bank (Creditor). Third, the obstacles faced by Notaries in making credit agreements include obstacles originating from debtors and objects of Mortgage Rights. Another obstacle comes from BPN, namely the slow process of registering Mortgage Rights, even though the supporting documents are complete.
