The purpose of this thesis is to understand the Airline liability to the families of Lion Air Flight JT 610 victims and the form of constraints faced by families of aircraft victims in receiving compensation insurance due to aircraft accident on domestic flight within the legal framework of Indonesia. The result showed under Article 3 of Minister of Transportation Regulation Number 77 of 2011 regarding Air Carrier Liability, Lion Air is liable to pay for passenger death due to aircraft carrier a total amount of IDR 1,250,000,000 (one billion two hundred fifty million Rupiah) in indemnity per passenger. However, in practice the payment of such Compulsory Compensation is followed by conditions set by air carrier so that next beneficiaries of victims will sign agreements relinquishing their rights to file claims against all parties related to the aircraft accident, but according to Law Number 1 of 2009 regarding Aviation, expressly forbids all efforts to eliminate airline liability. This paper uses library research, by reading and analyzing legislations, law literatures, newspapers, journals and other relevant written legal materials.
