In the medical world there are also found teachings on ethics and morals that are used as guidelines for carrying out their duties and obligations in serving the community. When the doctor violates the prevailing ethics and moral, sanctions will be imposed, either by professional groups that establish the code of ethics, or be subject to legal sanctions that will be processed and dropped by authorized legal of informed consent mecanism to prevent about malpractice climes. This reseacrh use normative empirical legal research, with descriptive analitycal approach. Base on the research conducted by the author, the obtained result that the informed consent has a function for patients and doctor, where the funcions for the doctor is informed consent providing security in performing medical procedurs on patients, as well to serve as a means of selfdefens against possible claims or lawsuits from patients or their families if someday arising from unintended. While in term of informed consent patients is a manifestation of rights of patients are entitled to information about the disease the medical action what to do, the possibillity that will occur upon decision of medical actions, the author provide reccomendation for this study was the doctors should perform well informed consent mechanism to prevent any malpractice suit of patients due to knowledge gap between patients as those new the world of health and doctor as profesinal.
