Abstract
Pandemi covid-19 di tahun 2020 telah berimplikasi pada kondisi perekonomian di
Indonesia termasuk pada praktik penggunaan instrumen hukum PKPU dan
kepailitan. Kasus PKPU dan Kepailitan meningkat termasuk yang sebagian besar
di ajukan oleh Kreditor. Keadaan ini tidak memberikan keadilan dan perlindungan
bagi Debitor. Kewenangan Kreditor dalam mengajukan permohonan PKPU justru
menjadi insentif yang melahirkan moral hazard dan menyimpang dari nilai dasar
filosofis PKPU. Untuk itu dengan metode penelitian yuridis normatif dan
perbandingan hukum, penelitian ini dilakukan guna memperoleh jawaban atas
permasalahan hukum dalam UU 37/2004 mengenai permohonan PKPU,
pelaksanaan kewenangan tersebut dan bagaimana pengaturan hukum yang ideal.
Hasil penelitian menunjukkan bahwa pengaturan PKPU dan kepailitan di beberapa
negara serta dari panduan UNCITRAL dan World Bank, memang memberikan
kewenangan bagi Kreditor untuk mengajukan. Hal ini sesuai dengan prinsip yang
dianut oleh masing-masing negara. Indonesia dalam mendasarkan pada 37/2004,
kewenangan diberikan juga kepada Kreditor. Kebijakan tersebut merupakan suatu
tindakan ”cangkok paksa” tidak ada pasal-pasal yang mendukung penegakan
kewenangan tersebut. Hasil penelitian menunjukan bahwa kewenangan Kreditor
seperti itu justru banyak digunakan sebagai alat paksa penagihan utang, vested
interest pihak profesional PKPU dan kepailitan dan bahkan sebagai jalan untuk
mempailitkan debitor. Oleh karenanya, kewenangan Kreditor ini perlu dihapuskan
dengan melakukan amandemen terhadap UU 37/2004.
The covid-19 pandemic in 2020 has had implications for economic conditions in
Indonesia, including the practice of using PKPU and bankruptcy legal instruments.
PKPU and Bankruptcy cases are increasing, including most of which are filed by
Creditors. This situation does not provide justice and protection for debtors. The
authority of Creditors in submitting PKPU applications has actually become an
incentive that creates moral hazard and deviates from the basic philosophical values
of PKPU. For this reason, using normative juridical research methods and
comparative law, this research was conducted to obtain answers to legal problems
in Law 37/2004 regarding PKPU applications, the implementation of this authority
and how the ideal legal arrangements. The results show that the PKPU and
bankruptcy regulations in several countries as well as from the UNCITRAL and
World Bank guidelines, do provide authority for Creditors to file. This is in
accordance with the principles adopted by each country. In Indonesia, based on
37/2004, the authority is also given to Creditors. The policy is an act of "forced
graft" there are no articles that support the enforcement of such authority. The
results of the research show that such authority of Creditors is actually widely used
as a means of forced debt collection, vested interests of PKPU and bankruptcy
professionals and even as a way to bankrupt the debtor. Therefore, the Creditor's
authority needs to be abolished by amending Law 37/2004.
