Abstract

Skripsi ini membahas tentang pertanggung jawaban pidana dari pelaku tindak produksi dan distribusi kosmetik berbahaya di Indonesia, dimana instrumen hukum yang berlaku di Indonesia yang dijadikan dasar hukumnya termasuk Undang-Undang, Peraturan Menteri Kesehatan Republik Indonesia, serta peraturan-peraturan dan pedoman lainnya yang diterbitkan oleh Badan Pengawas Obat dan Makanan Republik Indonesia. Adapun tujuan penelitian ini adalah untuk menjadi salah satu sumber informasi tentang produksi dan distribusi kosmetik di Indonesia, khususnya jika kegiatan tersebut tidak sesuai dengan dasar hukum yang berlaku. Pokok dari penelitian dan pembahasan adalah mengenai peraturan yang mendasari kegiatan produksi dan distribusi kosmetik di Indonesia. Penulis menggunakan metode penelitian hukum yuridis normatif dengan pendekatan perundang-undangan yang bersifat deskriptif dan didukung dengan studi kasus serta data hasil wawancara. Pembahasan Penulis adalah mengenai pengawasan serta implementasi hukum yang ada, badan hukum yang berwenang dan bertugas untuk memastikan bahwa kegiatan produksi dan distribusi kosmetik di Indonesia sesuai peraturan, dan memfokuskan pada sanksi pidana yang berlaku dari setiap instrumen hukum yang ada, serta implementasinya, yaitu penindak lanjutan yang dilakukan oleh aparat hukum Indonesia serta penyelesaian kasus-kasus terkait isu ini. Dari hasil pembahasan tersebut dapat disimpulkan bahwa walaupun peraturan yang ada sudah baik, namun implementasinya belum cukup. Maka dari itu, diperlukan komitmen pemerintah yang lebih lanjut dalam menangani isu ini. / This thesis discusses the criminal liabilities of the perpetrators of production and distribution of hazardous cosmetics in Indonesia, with the legal instruments in force in Indonesia as legal basis including Laws, Regulations of the Minister of Health of the Republic of Indonesia, as well as other regulations and guidelines issued by Republic of Indonesia Food and Drug Supervisory Agency. The purpose of this study is to be one of the sources of information about the production and distribution of cosmetics in Indonesia, especially if these activities are not in accordance with the positive laws applied. The subject of research and discussion focuses on the regulations that regulate the production and distribution of cosmetics in Indonesia. The author uses the method of normative juridical legal research with a statutory approach that is descriptive and is supported by case studies and interview data. The author discusses about the supervision and implementation of existing laws, the legal entities that have the authorities and duties to ensure that cosmetic production and distribution activities in Indonesia comply with the positive regulations, and focuses on the applicable criminal sanctions of any of the legal instruments, as well as their implementation, namely the follow-up conducted by Indonesian law enforcement agencies and the resolution of the cases related to this issue. From the results of the discussion it can be concluded that although the existing regulations are good, their implementation is not enough. Therefore, further government commitment is needed in dealing with this issue.
