Abstract

Notaries play a crucial role in banking transactions, especially in drafting loan agreements and settling loan agreements. In their role, notaries must remain neutral and impartial between the bank and the customer to ensure legal certainty in these transactions. However, there are cases where notaries can be involved as co-defendants in issues related tonotarial deeds, especially when non-performing loans occur. In this bad credit problem, the responsibility cannot be transferred to the notary, because the notary asks for the willingness and clarity of the parties involved before making an agreement, and the notary is not an investigator or technical.. Therefore, there is a need for a legal reinforcement to strengthen the notary profession in the banking sector. The main issues raised in this research are the regulation of the notary profession in the banking sector, the implementation of strengthening the regulation of the notary profession in the banking sector, and the conception of ideal regulation as an effort to prevent non-performing loans. The research used is normative juridical research with a statutory approach by collecting legal materials through document studies. From the analysis results, it can be stated that the regulation of the notary profession in the banking sector has been regulated in Indonesian Law Number 4 of 2023 concerning Development and Strengthening of the Financial Sector. By strengthening the regulation of the notary profession, the banking sector can reduce the risk of non-performing loans, increase customer confidence and maintain the integrity of banking transactions. The concept of regulating strengthening the notary profession can be realized through Indonesian Government Regulations (PP) as implementing regulations for the Indonesian P2SK Law and the Notary Profession Law (UUJN). The substance of this PP regulation must include concrete steps such as special education and training, special certification, a strict code of ethics, supervision mechanisms, transparency, reporting, and cooperation with banks and regulators.
