Abstract
With the modernization of technology and the internet, society’s daily activities have become increasingly dependent on online platforms, leading to widespread sharing and storage of personal data. This has raised global concerns about data security, especially within the European Union (EU), due to the increasing number of cybersecurity incidents. In response, the EU introduced the General Data Protection Regulation (GDPR) in 2018 to protect public data and address privacy risks. This research focuses on analyzing the development and implementation of the GDPR from 2018 to 2023. Using Neoliberal Institutionalism as a theoretical framework, this paper examines the concept of Privacy as a Human Right, International Norm, and International Institution. A qualitative, descriptive approach is adopted, with data from study review and online research collected and evaluated through narrative analysis. The research highlights how GDPR unified previously fragmented data protection laws across EU member states and provides insights into its wider data privacy and security implications, affecting governments in the aspect of having to establish Data Protection Authority (DPA) and enforce organizations to appoint Data Protection Officer (DPO) to ensure GDPR compliance. Businesses must also comply with GDPR due to heavy fines for non-compliance, and for individuals there are the added data protection through GDPR as organizations must have their given consent on the collection of their data. However, despite the comprehensive framework, the effectiveness of GDPR has been criticized as companies often find compliance costly, and public perceptions suggest that imposed fines are insufficient. / Dengan modernisasi teknologi dan internet, aktivitas sehari-hari masyarakat menjadi semakin bergantung pada platform daring, yang mengarah pada penyebaran dan penyimpanan data pribadi secara luas. Hal ini menimbulkan kekhawatiran global terkait kemanan data, terutama di Uni Eropa (UE), akibat meningkatnya jumlah insiden keamanan siber. Sebagai tanggapan, UE memperkenalkan General Data Protection Regulation (GDPR) pada tahun 2018 untuk melindungi data publik dan mengatasi risiko privasi. Penelitian ini berfokus pada analisis perkembangan dan implementasi GDPR dari tahun 2018 hingga 2023. Dengan menggunakan Institusionalisme Neoliberal sebagai kerangka teori, penelitian ini mengkaji konsep Privasi sebagai Hak Asasi Manusia, Norma Internasional, dan Lembaga Internasional. Pendekatan kualitatif dan metode deskriptif digunakan, dengan data dari tinjauan literatur dan penelitian daring yang dikumpulkan dan dievaluasi melalui analisis naratif. Penelitian ini menyoroti bagaimana GDPR menyatukan hukum perlindungan data yang sebelumnya terfragmentasi di seluruh negara anggota UE dan memberikan wawasan tentang implikasi privasi dan keamanan data yang lebih luas, yang memengaruhi Pemerintah pada pembuatan Data Protection Authority (DPA) dan pengaplikasian Data Protection Officer (DPO) kepada organisasi untuk pemastian adanya kepatuhan pada GDPR. Sektor bisnis juga turut diwajibkan patuh kepada GDPR melalui pemberian denda besar bagi yang tidak patuh, dan pada individu ada penambahan pada perlindungan data melalui GDPR, di mana organisasi diwajibkan untuk memiliki izin sepenuhnya dari masyarkat ketika mengumpulkan data. Namun, terlepas dari kerangka kerja yang komprehensif, efektivitas GDPR telah dikritik karena perusahaan sering kali merasa bahwa kepatuhan terhadap regulasi terlalu mahal, dan persepsi publik menunjukkan bahwa denda yang diberlakukan masih kurang memadai.
